Mala praxis: las causas de las causas y los perjuicios de los juicios / Bad praxis: the causes and the damages of the judments

RESUMEN

Es conocido el incremento en nuestro país y en el mundo de las acciones judiciales por responsabilidad civil en contra de los médicos (juicios por mala praxis). Este hecho obedece a una multiplicidad de causas entre las que podemos enumerar una mala relación médico-paciente, el decaimiento de la ética en general y la médica en particular, la información profusa y poco confiable con la que son bombardeados muchos de nuestros enfermos diariamente, la avidez de algunos abogados y un sistema de salud que es deficiente en varios aspectos y que obliga muchas veces a una atención indefinida y ambigua. También son varios los perjudicados, además del profesional, se deterioran casi todos los componentes del sistema de salud. La recreación de la ética, la reestructuración, aplicación y control de las leyes y una reforma del sistema sanitario se señalan como los factores más importantes para mitigar este flagelo que afecta a médicos, enfermos y hospitales.

ABSTRACT

The increase in our country and all over the world of the legal actions by civil responsibility against the medical doctors (MD) (judgments by bad praxis) is known. This fact obeys to a multiplicity of causes like a bad relation MD-patient, the decay of the ethics in general and the medical one, profuse and little reliable information with which many of our patients are stimulated daily, the avidity of some lawyers and a health system which is deficient in several aspects and sometimes an indefinite and ambiguous atten-tion. Also the harmed ones are several, in addition to the MD, all the components of the health system are deteriorated almost. The re-creation of the ethics, the re-construction, application and control of the laws and a reform of the health system are indicated as the factors most important to mitigate this flagellum that affects MD, patients and hospitals.
