RESUMO

El incremento de la práctica de diagnósticos genéticos preimplantacionales, en el contexto de las técnicas de reproducción asistida, genera nuevos ámbitos potenciales de responsabilidad. El riesgo de comportamientos negligentes en la práctica de este diagnóstico puede concretarse en cualquier momento y generar, consiguientemente, el planteamiento de una reclamación de indemnización por parte de los sujetos afectados por los daños derivados de ello. Este trabajo se centra en analizar la respuesta jurídica que ha de darse a estas reclamaciones cuando se fundamenten en un error en el diagnóstico por falso positivo


The increase in the practice of preimplantation genetic diagnosis, in the context of assisted reproductive technology, generates new potential areas of liability. Any moment can crystallize the risk of negligent behavior in the practice of this diagnosis and it can therefore generate a claim brought by the subjects who suffer the damages derived from it. This paper focuses on analyzing the legal response to be given to these claims when they are based on an error in the diagnosis by false positive

RESUMO

La introducción de los delitos relativos a la manipulación genética en el Código penal de 1995 fue celebrada como uno de los muchos aciertos que la política criminal contemporánea ha tenido y como una necesaria y urgente adaptación del Derecho penal a los avances científicos en la materia. Desde su creación el tipo penal recogido en el artículo 159 del Código penal ha recibido una necesaria labor interpretativa que la doctrina penal especializada ha llevado a cabo sobre su ubicación sistemática, su estructura general, los intereses protegidos en él, la conducta típica y la técnica de tipificación utilizada por el legislador al diseñar su morfología y elementos. En este trabajo se lleva a cabo el análisis de un segmento del tipo del artículo 159.1 del Código penal, compuesto todo él por elementos de difícil interpretación, centrándome en los conceptos de taras y de enfermedades graves, que son los utilizados por el legislador para complementar con un elemento intencional la estructura del tipo objetivo del delito. Debemos analizar secuencialmente su naturaleza y textura, su función en el contexto del tipo, su relación con el resto de elementos de la conducta típica y el proceso de determinación de su contenido. Ello nos aboca frontalmente con dilucidar si se trata de causas de justificación o elementos del tipo, y de ahí se derivará qué función tienen respecto al dolo del autor y la tipología del error sobre ellos


The introduction of crimes related to genetic manipulation in the 1995 Penal Code was celebrated as one of the many successes that contemporary criminal policy has had and as a necessary and urgent adaptation of criminal law to scientific advances in the matter. Since its creation, the criminal prohibition in the article 159 of the Criminal Code has received a necessary interpretative work that the specialized criminal science has carried out on its location, its general structure, the protected interests, the punished behavior and the technics on engineering used by the legislator when designing its morphology and elements. In this work is carried out the analysis of a part of the article 159.1 of the Penal Code, composed all of it by elements of difficult interpretation, focusing on the concepts of "defects" and "serious diseases", which are those used by the legislator to complement with an intentional element the structure of the crime. On these elements we must analyze sequentially its nature and texture, its function in the context of the criminal offence of which they are a part, its relationship with the rest of the elements and the process of filling its meaning. This leads us to determine whether these are causes of justification or elements of the criminal offence, and from there we will derive what role they have regarding the author's intent and the typology of the error cases on these elements

RESUMO

El artículo analiza críticamente, desde la perspectiva del bioderecho, la regulación penal de la manipulación genética en Colombia, evidenciando alguna de sus deficiencias más importantes, especialmente aquella de tutelar un bien jurídico de naturaleza colectiva. Luego, se elaboran y justifican algunas críticas a la construcción del tipo penal de manipulación genética para, finalmente, sustentar una propuesta de optimización de dicha regulación. Se concluirá que i) la estructura de la actual regulación penal de la manipulación genética en Colombia carece de exhaustividad y es imprecisa en, prácticamente, todos los puntos analizados en este trabajo, y que ii) el bioderecho representa un modelo jurídico capaz de otorgar más seguridad a la regulación penal de la manipulación genética en Colombia y otros ordenamientos legales del mundo


In this paper I critically analyze, from biolaw's point of view, the criminal regulation of genetic manipulation in Colombia by evidencing some of its most important deficiencies, especially in relation to protecting a legal interest of a collective nature. Then, some criticisms are elaborated and justified regarding the construction of the criminal type of genetic manipulation to finally offer and support a proposal of optimization for that regulation. It will be concluded that i) the structure of the current criminal regulation of genetic manipulation in Colombia lacks exhaustiveness and is imprecise in practically all the points analyzed in this work, and that ii) biolaw represents a legal model capable of granting more security and certainty to the criminal regulation of genetic manipulation in Colombia, as well as to other legal systems in the world

RESUMO

La maternidad subrogada se refiere a la implantación de un embrión creado por la tecnología de la fecundación in vitro (FIV) en una madre sustituta, o madre gestante, mediante un contrato con ella. Puede implicar a las familias naturales (mujer y hombre) con problemas de infertilidad o no, o a familias monoparentales o biparentales del mismo sexo. Atendiendo al origen de los gametos usados en la FIV surgen diversas situaciones en la relación genética del niño con la madre gestante y los padres comitentes. La maternidad subrogada se planteó en principio como una opción para solucionar problemas de infertilidad. Sin embargo, se ha convertido en una práctica posible y atractiva como fuente de recursos económicos para mujeres pobres. Los casos de maternidad por acuerdo, sin mediar un contrato, son excepcionales y no son apropiadamente "maternidad subrogada" sino de "maternidad altruista" debiendo ser considerados como casos de fertilización in vitro heteróloga. En este artículo se analizan las indicaciones sobre la utilización de la maternidad subrogada. También se tratan los aspectos médicos, genéticos y bioéticos que plantea esta nueva derivación de la fecundación in vitro. Como puntos de especial atención se plantean una serie de preguntas: ¿Se utiliza preferentemente para solucionar problemas de infertilidad?, ¿No es esto en la práctica una nueva forma de utilización de la mujer?, ¿no supone un atentado a la familia natural?, ¿No supone además un atentado a la dignidad de los seres humanos?


The subrogated motherhood takes place when an embryo created by in vitro fertilization (IVF) technology is implanted in a surrogate, sometimes called a gestational mother, by means a contract with her. It can imply to natural families (woman and man) with or without infertility problems, or to monoparental or biparental families of the same sex. Concerning the origin of the gametes used in the IVF emerges different implications on the genetic relationship of the resulting child with the surrogate and the future parents. The subrogated motherhood was initially considered an option to solve infertility problems. Nevertheless this practice has become a possible and attractive option as a source of economic resources for poor women. The cases of benefit of a pregnancy without mediating a contract are exceptional and they are not properly cases of "subrogated maternity" but of "altruistic maternity" and must be considered as heterologous in vitro fertilization. In this article are analyzed the medical, genetic and bioethics aspects of this new derivation of the fertilization in vitro. As points of special attention are considered the following questions: Is it the surrogate motherhood used preferably to solve infertility problems? Is not this actually a new form of exploitation of the woman? Does not suppose an attack to the natural family? Does not suppose in addition an attack to the dignity of the human being?

RESUMO

El artículo aborda la cuestión de la maternidad subrogada desde una perspectiva global. Analiza el fenómeno de la subrogación desde la óptica del derecho internacional y comparado y los efectos que la legalización de la subrogación altruista en los países del primer mundo puede tener sobre las mujeres en condiciones de vulnerabilidad en otros lugares del planeta. Concluye extrapolando las conclusiones de este análisis al debate actual sobre la legalización de la gestación por sustitución altruista en España


The article approaches the issue of surrogacy from a global point of view. Surrogacy is analysed from international and comparative law perspective, as well as the effects of the legalization of altruistic surrogacy in the first-world countries on vulnerable women in other parts of the world. The paper concludes extrapolating the conclusions of this analysis to the current debate about legalization of altruistic surrogacy in Spain

La maternidad por subrogación tiene una importante dimensión económica que, en los últimos años, se ha visto aún más potenciada. Se trata de una industria multimillonaria que, por otro lado, se aprovecha de mujeres con bajos recursos económicos. Frente a ello, existe una importante crítica, ejercida por distintos colectivos, que se refieren a este sector con términos tan cuestionables como "industria de alquiler de vientre", "granjas de bebé", "fábricas de niños", etc. Dichas críticas están siendo fuertemente contrarrestadas por los centros de maternidad por subrogación. A ello dedican ingentes presupuestos con estrategias que, asentadas en grandes dosis de sentimentalismo, logran transmitir una imagen positiva del proceso. El objetivo es proporcionar tranquilidad a los usuarios y a la sociedad en general. Para ello distorsionan las implicaciones éticas y jurídicas del proceso; en particular, niegan la explotación de las mujeres y la instrumentalización de los hijos que, necesariamente, implica esta técnica


Maternity by subrogation has an important economic dimension that, in the last years, has been even more potentiated. It is a multimillion-dollar industry that, on the other hand, takes advantage of women with low economic resources. Faced with this, there is an important criticism, carried out by different groups, that refer to this sector with such questionable terms as "uterine rental industry", "baby farms", "children's factories", etc. These criticisms are being strongly counteracted by maternity centers by subrogation. To this they dedicate enormous budgets with strategies that, based on great doses of sentimentality, manage to transmit a positive image of the process. The objective is to provide tranquility to users and to society in general. To this end they distort the ethical and legal implications of the process; in particular, deny the exploitation of women and the instrumentalization of the children that, necessarily, implies this technique
