A interface entre os Conselhos de Saúde do município de Vitória da Conquista e as manifestações dirigidas pelos usuários do SUS ao Ministério Público e Defensoria Pública / The interface between the Health Councils of the municipality of Vitória da Conquista and the manifestations directed by SUS users to the Public Ministry and Public Defender's Office

RESUMO

O Sistema Único de Saúde (SUS) se constitui em um dos grandes marcos de inclusão social do Brasil. Contudo, ainda enfrenta alguns desafios para a consolidação de um sistema de saúde universal e participativo. Estes desafios levam usuários ao Ministério Público e Defensoria Pública, para alcançarem direitos garantidos pela Constituição Federal de 88. Em contrapartida, espaços de participação social do SUS, como os Conselhos de Saúde, estão sendo pouco utilizados como instrumentos de controle social na busca da garantia de direitos à saúde. Dessa forma, o presente trabalho teve como objetivo principal analisar a atuação do Controle social da saúde, no município de Vitória da Conquista, fazendo uma interface com as manifestações remetidas aos órgãos essenciais à justiça, pelos usuários do SUS. O estudo trata de uma pesquisa descritiva de cunho qualitativo. Foram utilizados dados secundários disponibilizados pelo Ministério Público e Defensoria Pública e dados primários alcançados através de entrevistas realizadas com os usuários do SUS e com o defensor estadual e promotora pública. Os resultados foram analisados através da formulação de categorias, conforme modelo de Bardin. O defensor e a procuradora embora reconheçam a existência do conselho de saúde, percebem fragilidades nestes espaços e nunca participou e/ou participou pouco das reuniões.

ABSTRACT

The Sistema Único de Saúde (SUS) still faces a few challenges to maintaining an universal health care system. These challenges takes SUS users to the Public Ministry and Public Defense. Council, where they fight to have their rights granted by the Federal constitution of 88. Community Healthy Councils, that were created to provide a voice for patients and the public, are often not used as social instruments in the pursuit of providing access to health care. The present study aimed to analyze the performance of the Social Health Control, an organization located in the City of Vitória da Conquista that provides the interface between SUS users and the justice. The study contains qualitative research with primary data generated from interviews with SUS users and with the states defender and prosecutor. Secondary data was also used in the study and it was provided by the Public Ministry and Public Defense. The results were analyzed through category formulations as of Bardin's Model. The defender and prosecutor although recognizes the existence of the Health Council, sees weaknesses in these spaces and never or not often participated in their meetings. In general, users appeals to the Public Defense in search of spots in the Intensive Care Unit (ICU), where they can get treatment and/or drugs. Often they only have their demands solved by judicialization.Most of the users of SUS that were interviewed reported not having any knowledge of the health councils in their communities. Only one of the participants has ever attended a meeting organized by the organ-ization. The results indicates that establishing Health Councils does not solve SUS users prob-lems if there arent strategies to qualificate and stimulate social participation's in community spaces. It is also important to reinforce the dialogue between the representatives of justice, SUS management, users and employees through these social participation spaces. (AU)
