Resumo
O uso de animais hoje em pesquisas científicas é uma das questões mais conflitantes que envolvem pesquisadores, mercado e grupos de proteção aos animais, revelando principalmente a mudança da mentalidade social que ocorreu quanto ao tema durante o século XX. Os animais tem sua proteção constitucional garantida quanto aos maus-tratos e ao sofrimento, no entanto, a crueldade é consentida tanto pela própria Constituição quanto por leis infraconstitucionais quando ela visa o bem-estar humano, pois todo o ordenamento jurídico brasileiro tem uma base antropocêntrica, e tudo deve visar sempre a melhor qualidade de vida e a dignidade humana. Para se obter tal qualidade de vida também é necessário o desenvolvimento econômico, social e político do país, e cada vez mais tem se comprovado que o incentivo a P&D de inovações abarca tais resultados, sendo que o setor farmacêutico é um dos mais visados, pois trata-se de um mercado internacional multimilionário que sempre será necessário enquanto o homem continuar sua eterna busca pelas curas de doenças que o afligem. Porém, tal mercado é caro, competitivo, demanda muito tempo de pesquisa para pouca taxa de retorno. Para que se ultrapassem tais obstáculos, países em desenvolvimento como o Brasil têm optado por investir em universidades e instituições públicas para desenvolver essa parte da pesquisa, realizando parcerias com o setor privado para que o produto seja inserido no mercado. Aqui se enquadra o tema do presente trabalho, que é a experimentação animal e os contratos de P&D entre as universidades públicas e o setor farmacêutico, buscando responder se é possível conciliar o desenvolvimento científico com o bem-estar animal, e como fazer tal conciliação utilizando o direito. Para tanto a pesquisa teve como base o método dedutivo, utilizando a pesquisa bibliográfico-documental multidisciplinar. Além da área específica do direito, tornou-se necessário a pesquisa em filosofia, sociologia, medicina veterinária, medicina, farmácia, economia, entre outras. Conclui-se que é possível sim a associação entre bem-estar animal e desenvolvimento científico. O trabalho, portanto, aborda um tema atual, essencial para o desenvolvimento econômico, social e político dos países e sua inserção no mercado internacional: o seu desenvolvimento científico através de inovações, aliado cada vez mais com a preocupação ambiental e a proteção animal.
The use of animals in scientific research today is one of the most conflicting issues involving researchers, market and animals protection groups, mainly revealing the change of social mentality that took place during the twentieth century. Animals have their constitutional protection guaranteed regarding the mistreatment and suffering, however, the animal cruelty is consented by the Constitution itself and by infra constitution-laws when it seeks human well-being. All Brazilian legal system has an anthropocentric base and everything must always aim at better quality of life and human dignity. To achieve such quality of life is also needed economic, social and political development of the country, and it has shown that the incentive to R&D innovations covers such result. The pharmaceutical sector is one of the most targeted because it is a multimillion dollar international market that will always be necessary while the man continues his eternal search for all the diseases cures that afflict mankind. However, this market is expensive, competitive, demand a lot of time to do research and have a low return rate. Therefore, in order to overcome these obstacles, developing countries like Brazil have chosen to invest in universities and public institutions to develop this part of the research, establishing partnerships with the private sector for the product to be inserted in the market. Here fits the theme of this dissertation, which is animal testing and the R&D contracts between public universities and the pharmaceutical industry, seeking to answer whether it is possible or not to reconcile the scientific development with animal welfare, and how to make such reconciliation using the law. This research is based on the deductive method, using a multidisciplinary bibliographic and documentary research. In addition to the specific area of law, it became necessary research in philosophy, sociology, veterinary medicine, medicine, pharmacy, economics, among others. It concludes that it is possible the association between animal welfare and scientific development. This dissertation addresses a current topic, essential for economic, social and political development of countries and their insertion in the international market: its scientific development through innovations, combined with environmental concerns and animal welfare.
