Resumo
A socially responsible urban planning to a healthy environment: the current national solid waste policy on Integrated Solid Waste Management, based on the aspects of federalism predicted by the Federal Constitution of 1988. The evolution of the Brazilian urban planning is presented, with the discussion of the main laws that deal with the urban structure of the cities. After that, we study the main constitutionally determined social rights, with emphasis on the division of legislative powers and materials between the federal organisms for the public social policies to be carried out. Then, the main provisions of Federal Law No. 12.305/2010 are explained in details. A descriptive-analytical method was used, with analysis of legal and legislative texts and bibliography related to the urban and social fields. It was concluded that urban development policies should be designed to enable sustainable development, aiming at meeting the basic needs of present and future generations. In fact, based on the study and supported by constitutional, tax, and economic subsystems, the results indicate the need for legislative development that ensures special treatment for the recycling sector, in view of the constitutional assumptions of the social function of this economic activity.Este artigo analisa a atual Política Nacional de Gestão integrada de Resíduos Sólidos, a partir dos aspectos relacionados com o federalismo previsto na Constituição Federal de 1988. Assim, de início apresenta-se a evolução do planejamento urbano brasileiro, discutindo-se as principais legislações que tratam sobre a estruturação urbana das cidades. Em seguida, estuda-se os principais direitos sociais previstos constitucionalmente, com ênfase à repartição de competências legislativas e materiais entre os entes federados, para o cumprimento das políticas públicas sociais. Continuando, explana-se, de forma circunstanciada, os principais dispositivos da Lei Federal nº 12.305/2010. O método de procedimento utilizado foi o descritivo-analítico, tendo sido realizadas consultas à textos jurídicos, legislativos e à bibliografias inerentes aos campos urbanístico e social. De forma que, ao final concluiu-se que a política de desenvolvimento urbano deve ser destinada no sentido de possibilitar o desenvolvimento sustentável, objetivando o atendimento das necessidades fundamentais das gerações presentes e futuras. De fato, com base no estudo realizado e tendo como suporte os subsistemas constitucional, tributário e econômico, os resultados indicam para a conveniência de uma evolução legislativa que assegure tratamento diferenciado para o setor da reciclagem, tendo em vista os pressupostos constitucionais da função social da atividade econômica.
