Resumo

Desde a promulgação de nossa Carta Constitucional que estruturou, pelo menos do ponto de vista jurídico um Estado do Bem-Estar Social, várias de suas normas não tiveram efetividade plena. Isso não só porque parte de nossa sociedade jamais admitiu algumas inovações, mas também pelo motivo de que quando conseguimos a redemocratização, o sistema econômico já havia iniciado uma nova fase, a partir do fim do socialismo real do leste europeu. A Constituição Federal positivou Direitos Humanos na forma de Direitos Fundamentais, dentre eles o Direito ao Meio Ambiente Ecologicamente Equilibrado, que são os direitos básicos que garantem o mínimo existencial para garantia da Dignidade da Pessoa Humana. Entretanto há algumas décadas estamos assistindo uma série de alterações legislativas que constituem claros retrocessos ambientais. A comunicação do sistema econômico possui maior reverberação social o que nos leva a uma cegueira quanto aos verdadeiros valores a serem protegidos.(AU)
