O PAPEL DA POLÍTICA NACIONAL DE RESÍDUOS SÓLIDOS NA LOGÍSTICA REVERSA DA INDÚSTRIA FARMACÊUTICA BRASILEIRA: MEDICAMENTOS DE USO DOMICILIAR

Resumo

Os produtos farmacêuticos têm sido amplamente utilizados na medicina humana, veterinária, como cosméticos e produtos de higiene pessoal, sendo caracterizados como substâncias de caráter poluidor. No entanto, existe atualmente a preocupação relacionada ao descarte de medicamentos de uso domiciliar. A falta de uma legislação específica, ou mais clara, proporciona uma lacuna no processo de logística reversa das indústrias farmacêuticas no Brasil. A resolução para o problema envolve a proposição de medidas conjuntas, com a participação dos consumidores, fabricantes e distribuidores de medicamentos, o que vem sendo chamada de responsabilidade compartilhada, a partir da criação da Política Nacional dos Resíduos Sólidos (PNRS). Esta pesquisa tem o objetivo geral de analisar a logística reversa de medicamentos de uso domiciliar no Brasil à luz da PNRS, constituindo um estudo qualitativo de caráter descritivo, que envolveu a realização de entrevistas em profundidade com os gestores das empresas fabricantes de medicamentos, redes de farmácias e o Órgão Regulador do setor, além de análise documental das leis em vigor sobre o tema. Como resultados, identificou-se uma extensa cadeia de suprimento, a qual é responsável por todo o fluxo de informação e distribuição dos medicamentos. Identificou-se, também, que a indústria farmacêutica possui apenas um fluxo reverso de materiais avariados ou vencidos que se encontram em seus canais de distribuição, mas não possui processos consolidados para o retorno de resíduos de medicamentos ou medicamentos vencidos que estão em posse dos consumidores finais. Pode-se identificar nas empresas entrevistadas importantes direcionadores da logística reversa, cobrindo diversas dimensões, como por exemplo, a mercadológica, operacional, financeira e legal. Observou-se que a indústria farmacêutica ainda não está adequadamente preparada para atender ao que está estabelecido na PNRS, embora já exista uma articulação com seu sindicato de classe para que isto ocorra. Porém a falta de acordos setoriais e o cumprimento da responsabilidade compartilhada impactam o resultado esperado. Na visão das redes de farmácias, a PNRS ainda não está sendo cumprida pelo setor, apesar de haver programas de coleta de resíduos de medicamentos ou medicamentos vencidos em algumas redes de farmácias. Outro achado de pesquisa relevante é o fator custo operacional, o qual foi indicado por todos os elos da cadeia como um ponto impactante para a implementação da PNRS e que dificilmente poderá ser absorvido pela cadeia de suprimentos da indústria farmacêutica.
Pharmaceutical products have been widely used in human medicine, veterinary medicine, such as cosmetics and toiletries, being characterized as polluter kind of substances. Currently there are concerns related to the disposal of household medicines. The lack of specific legislation, or punctual, provides a gap in the reverse logistics process of the pharmaceutical industry in Brazil. The resolution to the problem involves the proposition of joint measures with the participation of consumers, manufacturers and distributors of medicines, which has been called shared responsibility, from the creation of the National Policy of Solid Waste (PNRS). This research has the general objective of evaluating the reverse logistics of home use of medicines in Brazil in the light of PNRS, constituting a qualitative study of descriptive character, which involved conducting in-depth interviews with managers of the drug companies, groups of pharmacies and the regulatory agency in the sector, and documentary analysis of the laws in force on the subject. As a result, we identified an extensive supply chain, which is responsible for all the information flow and distribution of medicines. It was found also that the pharmaceutical industry has only a reverse flow of damaged or expired materials that are in its distribution channels, but has consolidated processes for the return of waste drugs or expired medications that are in the hands of consumers finals. It is possible to identify the companies interviewed important factors of reverse logistics, covering several dimensions, such as the marketing, operational, financial and legal. It was observed that the pharmaceutical industry is not adequately prepared to attend to what is established in PNRS, although there is a link with your class union for this to occur, but the lack of sectorial agreements and the fulfillment of shared responsibility impact the expected result. In view of the pharmacy chains, the PNRS is not being fulfilled by the sector, although there are drug waste collection programs or medications losers in some groups of pharmacies. Another important research finding is the operating cost factor, which was indicated by all links in the chain as a striking point for the implementation of PNRS and that can hardly be absorbed by the pharmaceutical industry supply chain.
