RESUMO

Erroneous eyewitness identification evidence is likely the leading cause of wrongful convictions. To minimize this error, scientists recommend collecting confidence. Research shows that eyewitness confidence and accuracy are strongly related when an eyewitness identifies someone from an initial and properly administered lineup. However, confidence is far less informative of accuracy when an eyewitness identifies no one and rejects the lineup instead. In this study, I aimed to improve the confidence-accuracy relationship for lineup rejections in two ways. First, I aimed to find the lineup that yields the strongest confidence-accuracy relationship for lineup rejections by comparing the standard, simultaneous procedure used by police worldwide to the novel "reveal" procedure designed by scientists to boost accuracy. Second, I aimed to find the best method for collecting confidence. To achieve this secondary aim, I made use of machine-learning techniques to compare confidence expressed in words to numeric confidence ratings. First, I find a significantly stronger confidence-accuracy relationship for lineup rejections in the reveal than in the standard procedure regardless of the method used to collect confidence. Second, I find that confidence expressed in words captures unique diagnostic information about the likely accuracy of a lineup rejection separate from the diagnostic information captured by numeric confidence ratings. These results inform models of recognition memory and may improve the criminal-legal system by increasing the diagnostic value of a lineup rejection.

The primary goal of the presented research was to investigate how processing post-event information affects memory of details in an event viewed on video. We used two forms of post-event information: classic misinformation (changing or implanting new information into memory) and a new form that involves a correct explicit or implicit negation of the existence of an object in the video. We followed the three-step procedure used in studies on the misinformation effect, with a final memory test that was either immediate or delayed by a week and consisted in indicating which objects appeared in the video. We replicated the misinformation effect. More importantly, in the delayed test condition, both explicitly and implicitly negated objects were falsely recalled more often than unmentioned objects. These results indicate that it is possible to induce negation-related false memories; they also show that memory is impaired by negated post-event information or misleading post-event information.

When presented with a lineup, the witness is tasked with identifying the culprit or indicating that the culprit is not present. The witness then qualifies the decision with a confidence judgment. But how do witnesses go about making these decisions and judgments? According to absolute-judgment models, witnesses determine which lineup member provides the strongest match to memory and base their identification decision and confidence judgment on the absolute strength of this MAX lineup member. Conversely, relative-judgment models propose that witnesses determine which lineup member provides the strongest match to memory and then base their identification decision and confidence judgment on the relative strength of the MAX lineup member compared to the remaining lineup members. We took a critical test approach to test the predictions of both models. As predicted by the absolute-judgment model, but contrary to the predictions of the relative-judgment model, witnesses were more likely to correctly reject low-similarity lineups than high-similarity lineups (Experiment 1), and more likely to reject biased lineups than fair lineups (Experiment 2). Likewise, witnesses rejected low-similarity lineups with greater confidence than high-similarity lineups (Experiment 1) and rejected biased lineups with greater confidence than fair lineups (Experiment 2). Only a single pattern was consistent with the relative model and inconsistent with the absolute model: suspect identifications from biased lineups were made with greater confidence than suspect identifications from fair lineups (Experiment 2). The results suggest that absolute-judgment models better predict witness decision-making than do relative-judgment models and that pure relative-judgment models are unviable.

Benzodiazepines are commonly used drugs to treat anxiety in crime witnesses. These increase GABA inhibitory effects, which impairs aversive memory encoding and consolidation. Eyewitness memory is essential in justice. However, memory is malleable leading to false memories that could cause a selection of an innocent in a lineup. Here, we studied whether a low dose of Clonazepam impairs memory encoding as well as consolidation of faces and narrative of the event. We performed two experiments using a double-blind and between subject design (N = 216). Day 1: subjects watched a crime video and received Clonazepam 0.25 mg (CLZ group) or placebo (PLC group) before (Exp. 1) or after the video (Exp. 2) to assess the effect on encoding and consolidation. One week later, the memory was assessed using a present and absent target lineup and asking for a free recall. Regarding encoding, we found that in the CLZ group memory was impaired in the free recall task, while no differences were found for recognition memory. Regarding consolidation, we did not observe memory measures that were affected by this dose of benzodiazepines. The results suggest that while some aspects of eyewitness memory could be modulated even with low doses of benzodiazepine, others could not be affected. More studies should be performed with higher doses of CLZ similar to those administered in real life. These results are relevant in the judicial field to assess the reliability of the eyewitness elections under the effects of this drug.

Research is lacking regarding adults' ability to determine whether children's drawings are based on an experience or not. Drawings are useful in professional settings to alleviate linguistic demands, facilitate memory, and have been used as evidence. Determining the accuracy of veracity assessments of children's drawings would inform professionals regarding their use as evidence of experiences. Twenty-eight children (14 younger, Mage = 7.53 years, SDage = 1.19; 14 older, Mage = 11.67 years, SD = 1.27) produced drawings of two events: one staged experienced, and one narrative-based not experienced event. Fifty (Study 1, Mage = 23.72 years, SDage = 9.70) and 63 (Study 2, Mage = 25.92, SDage = 12.79) adults indicated whether each drawing was based on experience and their confidence in each assessment. In Study 2, additional drawing quality assessments were collected. Results indicated that adults were more accurate at distinguishing experienced than not experienced drawings for older artists. An inverse relationship was observed between confidence and accuracy-participants were more confident when they were inaccurate, especially for younger artists. Drawing quality improved with age and for drawings of experienced events. Adults tended to rate drawings of higher quality as resulting from experience leading to the highest accuracy for drawings from older artists that were based on experience. Overall, results suggest that there may be some features of drawings that allow for above chance levels of accuracy (up to 75%). However, rates are not high enough across assessments (M = 53.93%, range: 39%-75%) to reliably use them as indicators of experience.

Previous research has reported diverging patterns of results with respect to discriminability and response bias when comparing the simultaneous lineup to two different lineup procedures in which items are presented sequentially, the sequential stopping rule lineup and the UK lineup. In a single large sample experiment, we compared discriminability and response bias in six-item photographic lineups presented either simultaneously, sequentially with a stopping rule, or sequentially requiring two full laps through the items before making an identification and including the ability to revisit items, analogous to the UK lineup procedure. Discriminability was greater for the simultaneous lineup compared to the sequential stopping rule lineup, despite a non-significant difference in empirical discriminability between the procedures. There was no significant difference in discriminability when comparing the simultaneous lineup to the sequential two lineup and the sequential two lap lineup to the sequential stopping rule lineup. Responding was most lenient for the sequential two lap lineup, followed by the simultaneous lineup, followed by the sequential lineup. These results imply that sequential item presentation may not exert a large effect in isolation on discriminability and response bias. Rather, discriminability and response bias in the sequential stopping rule lineup and UK lineup result from the interaction of sequential item presentation with other aspects of these procedures.

The fact that memories can be distorted by post-event misinformation has cast considerable doubt over the dependability of eyewitness evidence in legal contexts. However, despite its adverse practical implications, the misinformation effect is likely an unavoidable distortion stemming from the reconstructive nature of episodic memory. Certain cognitive abilities have been reported to offer protection against misinformation, suggesting that mechanisms aside from episodic memory may also be underpinning this type of memory distortion. The purpose of this review was to collate findings of associations between eyewitness misinformation susceptibility and individual differences in cognitive ability in adults aged 18 and over. Nine studies met the eligibility criteria for this review, including 23 distinct associations. Using a narrative synthesis, three categories of cognitive ability were identified as influencing susceptibility to misinformation: general intelligence and reasoning, perceptual abilities, and memory abilities. Across almost all categories, higher levels of ability were associated with reduced susceptibility to misinformation. While there is no indication that any one trait provides total immunity to the misinformation effect, there is a reasonable amount of evidence to suggest that several cognitive abilities create variance in individual levels of susceptibility. Future research should investigate not only if but how these cognitive abilities protect against misinformation distortions, for example, by contributing to more detailed encoding of the memory, enhancing discrepancy detection in the face of post-event misinformation, or improving source-monitoring during an eyewitness memory test.

The memory conformity effect occurs when people witness a given incident (e.g. a crime) then talk to each other about it, and the statement of one person affects the memory account of the other person with respect to this incident. The aim of this article is to improve the quality of witness testimony by verifying the effectiveness of three methods that aim to reduce memory conformity effect: (1) an extended warning against misinformation; (2) a method based on information about memory functioning and its fallibility and (3) a method consisting in motivating participants to resist influence and demonstrating their individual vulnerability to it. In the presented experiment, the innovative MORI technique was used to study the memory conformity effect. This technique allows a pair of participants to sit beside each other, look at the same screen and see a different version of the same criminal event. In the next stages, the subjects are asked to answer a series of questions about different details, thereby introducing mutual misinformation; then, the participants perform an individual memory test. In the experimental conditions, this test was preceded by one of the three tested methods in each group, with the aim of determining their effectiveness in reducing memory conformity. It turns out that the implementation of an extended warning against misinformation eliminated the memory conformity effect, while the application of two other methods led to a reduction (but not complete elimination) of the studied phenomenon.

Experimental psychologists investigating eyewitness memory have periodically gathered their thoughts on a variety of eyewitness memory phenomena. Courts and other stakeholders of eyewitness research rely on the expert opinions reflected in these surveys to make informed decisions. However, the last survey of this sort was published more than 20 years ago, and the science of eyewitness memory has developed since that time. Stakeholders need a current database of expert opinions to make informed decisions. In this article, we provide that update. We surveyed 76 scientists for their opinions on eyewitness memory phenomena. We compared these current expert opinions to expert opinions from the past several decades. We found that experts today share many of the same opinions as experts in the past and have more nuanced thoughts about two issues. Experts in the past endorsed the idea that confidence is weakly related to accuracy, but experts today acknowledge the potential diagnostic value of initial confidence collected from a properly administered lineup. In addition, experts in the past may have favored sequential over simultaneous lineup presentation, but experts today are divided on this issue. We believe this new survey will prove useful to the court and to other stakeholders of eyewitness research.

Child eyewitnesses show a high false identification rate on target-absent (TA) lineups despite good performance on target-present (TP) lineups. One explanation is that children feel a social pressure to choose when presented with a TA lineup. We investigated whether experimenter familiarity would reduce social pressure and improve accuracy on TA lineups. Children (5-7 years, N = 120) watched a short video of a staged theft; 1-2 days later they completed a TP or TA lineup with a familiar or unfamiliar experimenter. Experimenter familiarity had an impact on lineup response in TA lineups only, with more correct 'not there' and fewer 'not sure' responses when the children were familiar with the experimenter. The results provide further evidence to support the social aspect of eyewitness identification decisions in children and provide a possible strategy to improve identification accuracy for those working with children in the criminal justice system.

Prior research regarding the influence of face structure on character judgments and first impressions reveals that bias for certain face-types is ubiquitous, but these studies primarily used decontextualized White faces for stimuli. Given the disadvantages Black men face in the legal system, this study aimed to investigate whether the criminal face-type presented in the context of crime influenced different legal system-type judgments as a function of perpetrator race. In a mixed-model design, participants saw Black and White computer-generated faces that varied in criminality presented with either violent or nonviolent crime scenarios. At test, participants attempted to identify the original perpetrator from a photo array, along with providing penalty severity judgments for the crime committed. Results indicate that when crimes were violent, participants meted harsher penalties overall to Black faces or to high-criminality faces identified as the perpetrator. Furthermore, for violent crimes, participants were more likely to select a face from the photo array that was higher/equally as high in criminality rating relative to the actual perpetrator when memory failed or when the perpetrator was Black. Overall, the findings suggest that when people are making judgments that could influence another's livelihood, they may rely heavily on facial cues to criminality and the nature of the crime; and this is especially the case for Black faces presented in the context of violent crime. The pattern of results provides further support for the pervasive stereotype of Black men as criminal, even in our racially diverse sample wherein 36% identified as Black.

In many criminal cases, outcomes rely on eyewitness evidence. Exposure to misleading information after an event reduces the accuracy of witnesses' memories. In some circumstances, warnings about misinformation can protect witnesses. As social media is a growing source of misleading information, this study examined the effect of misleading post-event information delivered via a social media-style video, as well as the utility of a minimal versus detailed warning. Participants (N = 145) watched a video showing an electrician stealing items from a client's home. Next, they received one of three pre-warnings regarding forthcoming misleading information: a minimal warning indicating that caution should be taken, a detailed warning specifying the presence of misleading information, or no warning. Participants received the misleading information via a social media video or a standard text-based narrative. Finally, they completed a recognition test. Although delivery method did not affect errors for misleading items, detailed warnings were only effective against text-based misleading information. Participants were more confident about their correct than incorrect responses for misleading items; confidence was not affected by delivery method or warning. This experiment is the first to demonstrate people's susceptibility to misleading post-event information delivered in a social media-style video using an eyewitness paradigm.

When selecting fillers to include in a police lineup, one must consider the level of similarity between the suspect and potential fillers. In order to reduce misidentifications, an innocent suspect should not stand out. Therefore, it is important that the fillers share some degree of similarity. Importantly, increasing suspect-filler similarity too much will render the task too difficult reducing correct identifications of a guilty suspect. Determining how much similarity yields optimal identification performance is the focus of the proposed study. Extant research on lineup construction has provided somewhat mixed results. In part, this is likely due to the subjective nature of similarity, which forces researchers to define similarity in relative terms. In the current study, we manipulate suspect-filler similarity via a multidimensional scaling model constructed using objective facial measurements. In doing so, we test the "propitious heterogeneity" and the diagnostic-feature-detection hypotheses which predict an advantage of lineups with low-similarity fillers in terms of discriminability. We found that filler similarity did not affect discriminability. We discuss limitations and future directions.

Researchers in cognitive and forensic psychology have long been interested in the impact of individual differences on eyewitness memory. The sex of the eyewitness is one such factor, with a body of research spanning over 50 years that has sought to determine if and how eyewitness memory differs between males and females. This research has significant implications across the criminal justice system, particularly in the context of gendered issues such as sexual assault. However, the findings have been inconsistent, and there is still a lack of consensus across the literature. A scoping review and analysis of the literature was performed to examine the available evidence regarding whether sex differences in eyewitness memory exist, what explanations have been proposed for any differences found, and how this research has been conducted. Through a strategic search of seven databases, 22 relevant articles were found and reviewed. Results demonstrated that despite the mixed nature of the methodologies and findings, the research suggests that neither males nor females have superior performance in the total amount of accurate information reported, but rather that females may have better memory for person-related details while males may perform better for details related to the surrounding environment. There was also consistent evidence for the own-gender bias. There was some consensus that differences in selective attention between males and females may underlie these sex differences in eyewitness memory. However, none of the studies directly tested this suggested attentional factor, and thus future research is needed to investigate this using a more systematic and empirical approach.

Individuals with aphantasia report an inability to voluntarily visually image and reduced episodic memory, yet episodic accounts provided by witnesses and victims are fundamental for criminal justice. Using the mock-witness paradigm, we investigated eyewitness memory of individuals with aphantasia versus typical imagers. Participants viewed a mock crime and 48 hours later were interviewed about the event, randomly allocated to one of three conditions. Two interview conditions included techniques designed to support episodic retrieval mode, namely (i) Mental Reinstatement of Context (MRC) and (ii) Sketch Reinstatement of Context (Sketch-RC). A third Control condition did not include retrieval support. Aphantasic mock-eyewitnesses recalled 30% less correct information and accounts were less complete, but they made no more errors and were as accurate as typical imagers. Interaction effects revealed reduced correct recall and less complete accounts for aphantasic participants in MRC interviews versus Sketch-RC and Control. Aphantaisic participants in the Control outperformed those in both the Sketch-RC and MRC, although Sketch-RC improved completeness by 15% versus MRC. Our pattern of results indicates reduced mental imagery ability might be compensated for by alternative self-initiated cognitive strategies. Findings offer novel insights into episodic recall performance in information gathering interviews when ability to voluntarily visualize is impoverished.

Considerable evidence has shown that repeating the same misinformation increases its influence (i.e., repetition effects). However, very little research has examined whether having multiple witnesses present misinformation relative to one witness (i.e., source variability) increases the influence of misinformation. In two experiments, we orthogonally manipulated repetition and source variability. Experiment 1 used written interview transcripts to deliver misinformation and showed that repetition increased eyewitness suggestibility, but source variability did not. In Experiment 2, we increased source saliency by delivering the misinformation to participants via videos instead of written interviews, such that each witness was visibly and audibly distinct. Despite this stronger manipulation, there was no effect of source variability in Experiment 2. In addition, we reported a meta-analysis (k = 19) for the repeated misinformation effect and a small-scale meta-analysis (k = 8) for the source variability effect. Results from these meta-analyses were consistent with the results of our individual experiments. Altogether, our results suggest that participants respond based on retrieval fluency rather than source-specifying information.

Two experiments examined whether brief mindful meditation exercises and belief in task utility impacted memory in the misinformation paradigm. Participants watched a fictionalized crime video, received post-event misinformation about the video, and completed a cued recall memory test. They were randomly assigned to complete either a brief mindfulness exercise or unrelated task prior to encoding the video (E1) or prior to the final cued recall test (E2). Further, half of the participants in each group were informed that their assigned task was beneficial to memory performance. In Experiment 1, information about task benefits reduced misinformation reports on the final recall test, regardless of the task. The brief mindfulness exercise increased self-reported mindfulness scores in both experiments. While no group differences in memory were found, correlational analyses across the two experiments suggest that individuals who achieve more intense states of mindfulness may have lower susceptibility to misinformation and better event memory when meditation occurs prior to encoding. The results suggest that brief mindfulness exercises can reliably increase state experiences of mindfulness and have potential for use as experimental manipulations. However, the intensity of a self-guided mindfulness experience can vary across individuals, so it is important to consider individual differences when considering the application of the exercises.

Research on eyewitness identification often involves exposing participants to a simulated crime and later testing memory using a lineup. We conducted a systematic review showing that pre-event instructions, instructions given before event exposure, are rarely reported and those that are reported vary in the extent to which they warn participants about the nature of the event or tasks. At odds with the experience of actual witnesses, some studies use pre-event instructions explicitly warning participants of the upcoming crime and lineup task. Both the basic and applied literature provide reason to believe that pre-event instructions may affect eyewitness identification performance. In the current experiment, we tested the impact of pre-event instructions on lineup identification decisions and confidence. Participants received non-specific pre-event instructions (i.e., "watch this video") or eyewitness pre-event instructions (i.e., "watch this crime video, you'll complete a lineup later") and completed a culprit-absent or -present lineup. We found no support for the hypothesis that participants who receive eyewitness pre-event instructions have higher discriminability than participants who receive non-specific pre-event instructions. Additionally, confidence-accuracy calibration was not significantly different between conditions. However, participants in the eyewitness condition were more likely to see the event as a crime and to make an identification than participants in the non-specific condition. Implications for conducting and interpreting eyewitness identification research and the basic research on instructions and attention are discussed.

The presence of a weapon in a scene has been found to attract observers' attention and to impair their memory of the person holding the weapon. Here, we examined the role of attention in this weapon focus effect (WFE) under different viewing conditions. German participants viewed stimuli in which a man committed a robbery while holding a gun or a cell phone. The stimuli were based on material used in a recent U.S. study reporting large memory effects. Recording eye movements allowed us to test whether observers' attention in the gun condition shifted away from the perpetrator towards the gun, compared with the phone condition. When using videos (Experiment 1), weapon presence did not appear to modulate the viewing time for the perpetrator, whereas the evidence concerning the critical object remained inconclusive. When using slide shows (Experiment 2), the gun attracted more gaze than the phone, replicating previous research. However, the attentional shift towards the weapon did not come at a cost of viewing time on the perpetrator. In both experiments, observers focused their attention predominantly on the depicted people and much less on the gun or phone. The presence of a weapon did not cause participants to recall fewer details about the perpetrator's appearance in either experiment. This null effect was replicated in an online study using the original videos and testing more participants. The results seem at odds with the attention-shift explanation of the WFE. Moreover, the results indicate that the WFE is not a universal phenomenon.
