Caracterização dos Termos de Consentimento submetidos a um Comitê de Ética em Pesquisa / Characterization of Terms of Consent submitted to a Committee of Ethics in Research

Foram analisados Termos de Consentimento Livre e Esclarecido (TCLE) originalmente submetidos por pesquisadores a um Comité de Ética em Pesquisa (CEP) com o objetivo de verificar a adequação às normas nacionais. Foi empregado método de investigação descritiva, exploratória, de abordagem quanti-qualitativa em que foram analisados 190 TCLE submetidos entre janeiro e outubro de 2013. Quatro categoriais analíticas foram delineadas para aferir a adequação 1) estrutura do documento; 2) detalhamento da pesquisa; 3) redação e linguagem; 4) informações sobre pesquisador. Entre as principais adequações identificaram-se o cumprimento dos aspectos formais do documento, incluindo a apresentação em forma de convite, linguagem adequada ao leigo, presença de informações sobre sigilo à identidade do voluntário e possibilidade de desistência da pesquisa. Dentre as inadequações mais significativas destacaram-se a ausência de informações suficientes para uma compreensão adequada dos estudos, omissão ou discussão sobre a relação entre benefícios, riscos e desconfortos e as medidas para sua redução. A análise dos dados aponta para a necessidade de fortalecimento da função educativa dos CEP com o intuito de levar à comunidade científica o melhor conhecimento sobre as normas e os fundamentos éticos que as sustentam. Pondera-se que TCLE com informações completas em linguagem acessível são essenciais ao legítimo exercício da autonomia, no entanto, mais importante que a assinatura formal de documentos impressos, é a fidedigna interação entre um participante esclarecido e um pesquisador que compreende a finalidade das normas que viabilizará o respeito à autonomia e a proteção da dignidade dos participantes das pesquisas.(AU)
Informed Consent (IC) originally submitted by researchers to a Committee of Ethics in Research (CEP) were analyzed aiming at evaluating their adequacy to national standards. We did a descriptive, exploratory, quantitative and qualitative research that analyzed 190 IC submitted between January and October 2013. Four analytical categories were outlined to assess the suitability 1) structure of the document; 2) detailing the research; 3) writing and language; 4) information on the researcher. Among the major adjustments we identified compliance with the formal aspects of the document including a presentation in the form of invitation, appropriate language, presence of information regarding the voluntarys confidentiality and the possibility of research withdrawal. Among the most significant inadequacies identified it stands out the absence of sufficient information for a proper understanding of the studies, omission or discussion about the relationship among benefits, risks and discomforts and measures for their reduction. Data analysis points to the need of strengthening the educational function of CEP in order to bring the scientific community the best knowledge about the rules and ethical foundations that support them. We ponder that IC with complete information in accessible language are essential to the legitimate exercise of autonomy. However, more important tan the formal signing of printed documents is the reliable interaction between a savvy participant and a researcher who understands the purpose of the rules that will enable respect for autonomy and the protection of the dignity of research participants.(AU)
