RESUMO

This RCD discusses the recent development in Lange v Houston County. In this case, the United States District Court for The Middle District Of Georgia Macon Division found that an Exclusion Policy, prohibiting health insurance coverage of gender-affirming surgery for an employee, Anna Lange, violated Title VII of the Civil Rights Act. On appeal, the Defendants argued that the District Court erred in its decision and relied on the cost burden of gender-affirming surgery as one of their defenses. This RCD highlights that cost is a common defense tactic used by defendants in these cases. However, the author argues that these concerns are unfounded and meritless given the cost-effectiveness of including gender-affirming surgeries in health insurance plans, as highlighted in the RCD.

No Brasil, o trabalho doméstico remunerado é essencialmente feminino e emprega cerca de 5,9 milhões de mulheres, correspondendo a 16,8% da ocupação feminina. Desse contingente, 61 % são compostos por mulheres negras. As empregadas domésticas estiveram historicamente submetidas a uma série de aspectos excludentes, como baixa remuneração, contratações à margem da legalidade e discriminação de gênero e raça. Esta pesquisa objetivou compreender a resistência enquanto categoria fundamental para compreensão do trabalho doméstico. Ao falar sobre essa categoria, destacamos a subjetividade que constitui os fenômenos sociais, partindo de uma compreensão dialética e histórica do sujeito e da relação indivíduo-sociedade, inserida em uma historicidade. Os resultados encontrados, coletados por meio de documentos, notícias, reportagens, participações no sindicato da categoria e da realização de entrevistas com cinco domésticas apontam a existência de formas de resistência no campo do trabalho doméstico, compondo movimentos de oposição e reação ao modus operandi colonial e às hierarquias de gênero-raça-classe que formam a sociedade brasileira. A psicologia sócio-histórica foi escolhida como abordagem teórico-metodológica, pois possibilita compreender do homem como ser ativo, social e histórico. Ao investigar as formas de resistência presentes nesse tipo de trabalho, compreende-se a trabalhadora doméstica não como mera consequência da realidade social em que se insere, mas como sujeito ativo que constitui essa realidade e é simultaneamente constituído por ela. Com esta pesquisa, pretende-se contribuir com a crítica à ideologia dominante que subalterniza essas trabalhadoras e as relega à subcidadania, uma condição sem reconhecimento e direitos.(AU)


In Brazil, paid domestic work is essentially female and employs about 5.9 million women, corresponding to 16.8% of the female occupation. Of this contingent, 61% is made up of black women. Domestic workers have historically been subjected to a series of exclusionary aspects, such as low remuneration, hiring outside the legal system and gender and race discrimination. This research aimed to understand resistance as a fundamental category for understanding domestic work. When talking about this category, we highlight the subjectivity that constitutes social phenomena, starting from a dialectical and historical understanding of the subject and the individual-society relationship, inserted in a historicity. The results found, collected from documents, news, reports, participation in the category union and interviews with five domestic workers, point to the existence of forms of resistance in the field of domestic work, composing movements of opposition and reaction to the colonial modus operandi and the gender-race-class hierarchies that make up Brazilian society.Socio-historical psychology was chosen as a theoretical-methodological approach, since it provides an understanding of man as an active, social and historical being. When investigating the forms of resistance present in this type of work, the domestic worker is understood not as a mere consequence of the social reality in which she is inserted, but, as an active subject, who constitutes this reality and is simultaneously constituted by it. This research intends to contribute to the criticism of the dominant ideology that subordinates these workers and relegates them to a sub-citizenship, a condition without recognition and rights.(AU)


El trabajo doméstico remunerado en Brasil es predominantemente femenino y emplea casi 5,9 millones de mujeres, lo que corresponde al 16,8% de la ocupación femenina. El 61% de este grupo está compuesto por mujeres negras. Históricamente, las trabajadoras del hogar han sido sometidas a una serie de aspectos excluyentes, como la baja remuneración, la contratación fuera del sistema legal y la discriminación de género y raza. Esta investigación tuvo como objetivo comprender la resistencia como categoría fundamental para entender el trabajo doméstico. Al hablar de esta categoría, se destaca la subjetividad que constituye los fenómenos sociales a partir de una comprensión dialéctica e histórica del sujeto y la relación individuo-sociedad, insertada en una historicidad. Los datos recogidos de documentos, noticias, participación en la categoría unión y entrevistas con cinco sirvientas permitieron concluir que existen formas de resistencia en el ámbito del trabajo doméstico, que se componen de movimientos de oposición y reacción al modus operandi colonial y a jerarquías de género-raza-clase que conforman la sociedad brasileña. La psicología sociohistórica fue el enfoque teórico-metodológico utilizado, ya que proporciona una comprensión del ser humano como ser activo, social e histórico. El análisis de las formas de resistencia presentes en este tipo de trabajo permite identificar la trabajadora doméstica no como una mera consecuencia de la realidad social en la cual se inserta, sino como sujeto activo que constituye esta realidad y, a la vez, es constituido por ella. Se espera que esta investigación pueda contribuir a la crítica de la ideología dominante que subordina a estas trabajadoras, relegándolas a una subciudadanía, una condición sin reconocimiento y sin derechos.(AU)

OBJECTIVE: Using data from 2017, the authors have previously examined the coverage of obesity-related services in state employee health plans since 2009 and found improvements in coverage for obesity-related treatments. This study repeated the collection of similar data for 2021 and explored whether coverage had continued to increase or decline. METHODS: Data on obesity benefits for state employees were obtained from publicly available documents from relevant state websites. Source documents were reviewed for language that would indicate the availability of coverage for nutritional counseling, pharmacotherapy, and bariatric surgery. Use data were collected when available, but availability was limited. RESULTS: Coverage for some treatments of obesity continued to trend upward, as was the case between 2009 and 2017, but coverage for pharmacotherapy declined from 2017 to 2021. Use data were received from only eight states; analysis of these data indicated underuse of obesity benefits by plan enrollees compared with each state's rate of obesity. CONCLUSIONS: Despite promising new therapies, states in 2021 were less likely to provide coverage for antiobesity medications. Additionally, limited use data suggested that few eligible individuals may be receiving these services. In conclusion, state employee health plans are currently inadequate given the prevalence, severity, and costs of obesity.

RESUMO

COVID-19 hospitalizations among unvaccinated individuals cost billions of dollars. More employers are considering imposing a premium surcharge on employees participating in the company's health plan who are not vaccinated against COVID-19. These employers see this approach as similar to health premium surcharges for tobacco use, justifying the higher premiums on the basis that unvaccinated individuals could cause the plan to experience higher hospitalization and related costs. However, imposing a surcharge on unvaccinated employees will require employers to think through legal and policy implications and the interests of their employees and their businesses. Employers should weigh their vaccination goals against these interests and consider whether a legally compliant surcharge would further their goals. Employers should carefully consider the prevailing culture among their employees and assess whether the policy would be effective and noncoercive. Premium surcharges may be effective for some but not all employers.

BACKGROUND: Chronic kidney disease (CKD) is an independent risk factor for progression to an end-stage renal disease requiring dialysis or kidney transplantation. We investigated the association of lifestyle behaviors with the initiation of renal replacement therapy (RRT) among CKD patients using an employment-based health insurance claims database linked with specific health checkup (SHC) data. METHODS: This retrospective cohort study included 149,620 CKD patients aged 40-74 years who underwent a SHC between April 2008 and March 2016. CKD patients were identified using ICD-10 diagnostic codes and SHC results. We investigated lifestyle behaviors recorded at SHC. Initiation of RRT was defined by medical procedure claims. Lifestyle behaviors related to the initiation of RRT were identified using a Cox proportional hazards regression model with recency-weighted cumulative exposure as a time-dependent covariate. RESULTS: During 384,042 patient-years of follow-up by the end of March 2016, 295 dialysis and no kidney transplantation cases were identified. Current smoking (hazard ratio: 1.87, 95% confidence interval, 1.04─3.36), skipping breakfast (4.80, 1.98─11.62), and taking sufficient rest along with sleep (2.09, 1.14─3.85) were associated with the initiation of RRT. CONCLUSIONS: Among CKD patients, the lifestyle behaviors of smoking, skipping breakfast, and sufficient rest along with sleep were independently associated with the initiation of RRT. Our study strengthens the importance of monitoring lifestyle behaviors to delay the progression of mild CKD to RRT in the Japanese working generation. A substantial portion of subjects had missing data for eGFR and drinking frequency, warranting verification of these results in prospective studies.

INTRODUCCIÓN: La elevada inflación argentina puede comprometer el acceso a los medicamentos, incluso con cobertura de la seguridad social. El objetivo de este estudio fue describir la evolución entre 2011 y 2019 de la cobertura del Instituto Nacional de Servicios Sociales para Jubilados y Pensionados (INSSJyP, también conocido como PAMI) y del Instituto de Obra Médico Asistencial (IOMA) para una selección de medicamentos de uso ambulatorio, fuera de patente, de consumo frecuente en patologías prevalentes, y evaluar si la evolución del ingreso de los beneficiarios acompañó el aumento del gasto de bolsillo para estos fármacos. MÉTODOS: Se registró la evolución del precio de venta al público (PVP) y de la cobertura por INSSJyP y por IOMA en los cuatrienios 2011-2015 y 2015-2019 para una selección de 10 fármacos utilizados en enfermedades crónicas de alta prevalencia. Se calculó la evolución del gasto de bolsillo para las presentaciones promedio, más barata y más cara de cada fármaco, y se comparó con la evolución de los ingresos de los beneficiarios. RESULTADOS: La cobertura promedio del INSSJyP para los fármacos estudiados subió de 63% en 2011 a 73% en 2019. La cobertura del PVP promedio por el IOMA fue de 55% en 2011 y descendió a 36% en 2019, debido a la demora en la actualización de los montos fijos. Para los beneficiarios de ambas instituciones el gasto de bolsillo creció menos que el ingreso en 2011-2015 pero lo superó ampliamente en 2015-2019. DISCUSIÓN: El sistema de cobertura por monto fijo tiene ventajas conceptuales, pero requiere una actualización oportuna de los valores con la inflación

OBJECTIVE: To examine the effect of an employer-mandated switch to high-deductible health plans (HDHP) on emergency department (ED) low-value imaging. DATA SOURCES: Claims data of a large national insurer between 2003 and 2014. STUDY DESIGN: Difference-in-differences analysis with matched control groups. DATA COLLECTION/EXTRACTION METHODS: The primary outcome is low-value imaging during ED visits for syncope, headache, or low back pain. We included members aged 19-63 years whose employers offered only low-deductible (≤$500) plans for one (baseline) year and, in the next (follow-up) year, offered only HDHPs (≥$1000). Contemporaneous members whose employers offered only low-deductible plans for two consecutive years served as controls. The groups were matched by person and employer propensity for HDHP switch, employer size, baseline calendar year, and baseline year quarterly number of total and imaged ED visits for each condition. We modeled the visit-level probability of low-value imaging using multivariable logistic regression with member-clustered standard errors. We also calculated population level monthly cumulative ED visit rates and modeled their trends using generalized linear regression adjusting for serial autocorrelation. PRINCIPAL FINDINGS: After matching, we included 524 998 members in the HDHP group and 5 448 803 in the control group with a mean age of approximately 42 years and 48% female in both groups. On visit-level analyses, there were no significant differential changes in the probability of low-value imaging use in the HDHP and control groups. In population-level analyses, compared with control group members, members who switched to HDHPs experienced a relative decrease of 5.9% (95% CI - 10.3, -1.6) in ED visits for the study conditions and a relative decrease of 5.1% (95%CI -9.6, -0.6) in the subset of ED visits with low-value imaging. CONCLUSION: Though HDHP switches decreased ED utilization, they had no significant effect on low-value imaging use after patients have decided to seek ED care.

BACKGROUND: Oncologic treatment has been associated with unemployment. As endometrial cancer is highly curable, it is important to assess whether patients experience employment disruption after treatment. We evaluated the frequency of employment change following endometrial cancer diagnosis and assessed factors associated with it. METHODS: A cohort of patients 18-63 years-old who were diagnosed with endometrial cancer (January 2009-December 2017) were identified in the Truven MarketScan database, an insurance claims database of commercially insured patients in the United States. All patients who were working full- or part-time at diagnosis were included and all employment changes during the year following diagnosis were identified. Clinical information, including use of chemotherapy and radiation, were identified using Common Procedural Terminology codes, and International Statistical Classification of Diseases codes. Cox proportional hazards models incorporating measured covariates were used to evaluate the impact of treatment and demographic variables on change in employment status. RESULTS: A total of 4381 women diagnosed with endometrial cancer who held a full-time or part-time job 12 months prior to diagnosis were identified. Median age at diagnosis was 55 and a minority of patients received adjuvant therapy; 7.9% received chemotherapy, 4.9% received external-beam radiation therapy, and 4.1% received chemoradiation. While most women continued to work following diagnosis, 21.7% (950) experienced a change in employment status. The majority (97.7%) of patients had a full-time job prior to diagnosis. In a multivariable analysis controlling for age, region of residence, comorbidities, insurance plan type and presence of adverse events, chemoradiation recipients were 34% more likely to experience an employment change (HR 1.34, 95% CI 1.01-1.78), compared to those who only underwent surgery. CONCLUSION: Approximately 22% of women with employer-subsidized health insurance experienced a change in employment status following the diagnosis of endometrial cancer, an often-curable disease. Chemoradiation was an independent predictor of change in employment.

INTRODUCTION: We examined health insurance benefits, workplace policies, and health promotion programs in small to midsize businesses in Alaska whose workforces were at least 20% Alaska Native. Participating businesses were enrolled in a randomized trial to improve health promotion efforts. METHODS: Twenty-six Alaska businesses completed from January 2009 through October 2010 a 30-item survey on health benefits, policies, and programs in the workplace. We generated frequency statistics to describe overall insurance coverage, and to detail insurance coverage, company policies, and workplace programs in 3 domains: tobacco use, physical activity and nutrition, and disease screening and management. RESULTS: Businesses varied in the number of employees (mean, 250; median, 121; range, 41-1,200). Most businesses offered at least partial health insurance for full-time employees and their dependents. Businesses completely banned tobacco in the workplace, and insurance coverage for tobacco cessation was limited. Eighteen had onsite food vendors, yet fewer than 6 businesses offered healthy food options, and even fewer offered them at competitive prices. Cancer screening and treatment were the health benefits most commonly covered by insurance. CONCLUSION: Although insurance coverage and workplace policies for chronic disease screening and management were widely available, significant opportunities remain for Alaska businesses to collaborate with federal, state, and community organizations on health promotion efforts to reduce the risk of chronic illness among their employees.

BACKGROUND: Rising medical costs are a significant concern for employers offering health benefits to employees, and there is interest in identifying insurance plan designs that optimize the effect of pharmacy benefits on overall costs. For instance, employers must decide between plans that carve in pharmacy benefits (where medical and pharmacy benefits are integrated into 1 package through an insurer) versus plans that carve out pharmacy benefits (where pharmacy benefits are separately administered through a pharmacy benefit manager). Little is known about the effect of carving in pharmacy benefits on medical utilization and costs. OBJECTIVE: To compare the effect of carving in versus carving out pharmacy benefits on medical utilization, medical costs, and health management program participation in commercial health plans. METHODS: We performed a propensity score-matched analysis comparing carve-in and carve-out members of a regional health plan in 2018. Our primary outcomes were medical utilization (annual medical claims/1,000 members) and costs (medical costs per member per month [PMPM]). We categorized these into the following domains: inpatient, emergency department, outpatient/ambulatory surgery, urgent care, primary care, specialist services, and diagnostics (laboratory testing/imaging). We additionally assessed participation in health plan-based health management programs. RESULTS: We analyzed 9,633 carve-in members matched with 9,633 carve-out members. Compared with carving out pharmacy benefits, carving in was associated with 3.7% lower medical costs, with an $8.73 reduction in PMPM ($225.87 vs. $234.60), and no significant difference in medical utilization; significantly lower inpatient and urgent care claims (reduction of 9.29 claims/1,000 and 51.3 claims/1,000, respectively) and costs ($10.08 and $0.12 PMPM reduction, respectively); lower injectable medical therapy costs ($4.32 PMPM reduction); and higher durable medical equipment costs ($2.14 PMPM increase). Carve-in members also experienced 4.9% higher health management program participation. CONCLUSIONS: As employers attempt to understand the value of carving in versus carving out pharmacy benefits to health plans, our findings suggest that carving in pharmacy benefits is associated with reduced medical costs and hospitalizations. Our findings can assist in informing employer decision-making processes and, as a result, reducing costs of care. DISCLOSURES: No outside funding supported this study. RESUMO

Use of increased premiums for tobacco users in the small-group market fell to 4.1 percent in 2018 from 17.8 percent in 2017 and 16.2 percent in 2016. This decline, possibly due to increased government oversight, occurred without any significant change in the prevalence of tobacco cessation programs. Thus, fewer workers are subject to tobacco surcharges without being provided cessation resources.

BACKGROUND: The Japanese Ministry of Health, Labour and Welfare introduced Specific Health Checkups (SHC) to identify individuals at risk of metabolic syndrome (MS). This study aimed to describe the SHC database developed by the Japan Medical Data Center Co., Ltd. (JMDC) as a means of exploring lifestyle behaviors and lifestyle diseases among working generations. METHODS: We conducted a retrospective, cross-sectional study of employees and their families using the JMDC-SHC database to describe the prevalence of lifestyle behaviors (smoking, exercise, dietary habits, drinking habits, and sleeping) and lifestyle diseases (MS, hypertension, dyslipidemia, and diabetes mellitus). Results were compared with data from the 2015 National Health and Nutrition Survey (NHNS) in Japan as a benchmark. RESULTS: All 646,869 enrollees in the JMDC-SHC database were included, of whom 66.5% were men. Age ranged from 40-74 years. Compared with the results of the NHNS, the JMDC-SHC subjects were younger and had fewer MS components and a lower prevalence of diabetes and hypertension. Subjects in their 40s were most likely to have unhealthy lifestyle behaviors in all age groups (eg, smoking: 41.0% in men and 10.2% in women). The SHC group had more favorable behaviors overall, but underweight was more prevalent in the SHC females. CONCLUSIONS: The JMDC-SHC population showed different lifestyle and lifestyle disease profiles to the NHNS population, probably due to its different age, gender, and employment distributions. Development of healthcare policies and plans for working generations would benefit from the selection of an age- and employment-appropriate database.

Aim: To estimate direct and indirect costs of surgical treatment of abnormal uterine bleeding (AUB) from a self-insured employer's perspective. Methods: Employer-sponsored insurance claims data were analyzed to estimate costs owing to absence and short-term disability 1 year following global endometrial ablation (GEA), outpatient hysterectomy (OPH) and inpatient hysterectomy (IPH). Results: Costs for women who had GEA are substantially less than costs for women who had either OPH or IPH, with the difference ranging from approximately $7700 to approximately $10,000 for direct costs and approximately $4200 to approximately $4600 for indirect costs. Women who had GEA missed 21.8-24.0 fewer works days. Conclusion: Study results suggest lower healthcare costs associated with GEA versus OPH or IPH from a self-insured employer perspective.

TRICARE is the military's health plan that provides coverage to 9.4 million active duty and retired uniformed services personnel and their family members. The TRICARE pharmacy benefit has undergone many changes in the last decade. These changes include assigning newly approved drugs to nonformulary status after regulatory approval, the addition of weight loss medications to the benefit, channel management point-of-service requirements for some medications, and copay increases. Several initiatives have resulted in significant cost avoidance to the Department of Defense (DoD). The purpose of this article is to discuss the changes to the TRICARE pharmacy benefit, describe the continual challenges, and estimate cost savings associated with implementation of these changes. DoD implemented its 3-tier Uniform Formulary in 2005. Since then, many changes have been enacted, including more extensive use of prior authorization, step therapy, and quantity limits; coverage of over-the-counter medications; the retail refund program; coverage of vaccines and smoking cessation agents; mandatory mail/military treatment facility requirements; rapid review and initial nonformulary status for newly approved innovator drugs; revisions to the compounded drug benefit; initial deployment of a new medical record system; coverage of weight loss medications; and the ability to exclude medications from the Uniform Formulary. Although the TRICARE pharmacy benefit has evolved significantly, the focus remains on the beneficiaries, with an overall goal of providing integrated, affordable, and high quality health services for the Military Health System. Challenges for the future include maximizing clinical effectiveness in the face of rising pharmaceutical costs and cost avoidance, while supporting the needs of TRICARE beneficiaries. Introduction: We assessed changes in screening mammography cost sharing and utilization before and after the Affordable Care Act (ACA) and the revised U.S. Preventive Services Task Force (USPSTF) recommendations by race and income. Methods: We used Optum™© Clinformatics™® Data Mart deidentified patient-level analytic files between 2004 and 2014. We first visually inspected trends for screening mammography utilization and cost-sharing elimination over time by race and income. We then specifically calculated the slopes and compared trends before and after 2009 and 2010 to assess the impact of ACA implementation and USPSTF recommendation revisions on screening mammography cost-sharing elimination and utilization. All analyses were conducted in 2018. Results: A total of 1,763,959 commercially insured women, ages 40-74, were included. Comparing trends for cost-sharing elimination before and after the 2010 ACA implementation, a statistically significant but small upward trend was found among all races and income levels with no racial or income disparities evident. However, screening utilization plateaued or showed a significant decline after the 2009 USPSTF recommendation revision in all income and racial groups except for African Americans in whom screening rates continued to increase after 2009. Conclusions: Impact of ACA cost-sharing elimination did not differ among various racial and income groups. Among our population of employer-based insured women, the racial gap in screening mammography use appeared to have closed and potentially reversed among African American women. Continued monitoring of screening utilization as health care policies and recommendations evolve is required, as these changes may affect race- and income-based disparities.
