Over the past decade, the potential impact of cognitive bias in forensic science has instigated much discussion and debate between academics, scientists and those in the justice sector. Evidence of bias influencing subjective decision-making across a range of forensic disciplines has been described in the literature. Forensic service organisations are being urged to address cognitive bias in subjective decision-making by designing processes or procedures to limit access to (irrelevant) contextual information or reduce dependence on cognitive functions. Although some laboratories have implemented bias mitigating strategies, with varying impact on operational efficiency, there has been no systematic assessment of the risk posed by cognitive bias. Forensic Science SA assessed the potential impact of bias on forensic interpretations across multiple disciplines, using a risk management framework. This process proved useful in assessing the effectiveness of existing bias mitigating strategies and identified the latent level of risk posed. While all forensic organisations should seek to implement bias limiting measures that are simple, cost-effective and do not adversely impact efficiency, using a risk-based approach has contextualised the limited benefit of introducing resource hungry measures, as postulated in the literature. That is not to suggest that forensic organisations should dismiss the potential influence of cognitive bias but they need to strike an appropriate balance between risk and return, as they do with any business risk.

In a previous publication we described a systems approach to forensic science applied in the military domain. The forensic science 'system of systems' describes forensic science as a sub-system in the larger criminal justice, law enforcement, intelligence, and military systems, with quality management being an important supporting system. Quality management systems help to ensure that organisations achieve their objective and continually improve their capability. Components of forensic science quality management systems can include standardisation of processes, accreditation of facilities to national/international standards, and certification of personnel. A fit for purpose quality management system should be balanced to allow organisations to meet objectives, provide continuous improvement; mitigate risk; and impart a positive quality culture. Considerable attention over the last decades has been given to the need for forensic science quality management systems to meet criminal justice and law enforcement objectives. More recently, the need for the forensic quality management systems to meet forensic intelligence objectives has been considered. This paper, for the first time, discusses the need for a fit for purpose quality management system for military forensic exploitation.

RESUMO

The beginnings of forensic genetics, one of the most rapidly growing fields of research, can be traced to Great Britain in 1985. It appeared in Poland in 1989. It uses the most advanced technologies, including the investigation of the variability of the human genome through mass parallel sequencing, which help, among other things, to analyze features of human appearance and origin. These technologies coexist with well standardized techniques of multiplex short tandem repeat analysis based on capillary electrophoresis, which allows to obtain a unique individual profile at a minimal cost. Legislation, research standards and guidelines developed by opinion-forming institutions and expert teams play a key role in the field of genetic forensic examinations. This study presents the current normative state of this area. It precedes the presentation of guidelines concerning the main aspects of research in the field of forensic genetics in Poland, prepared by a team of experts gathered within the Polish Speaking Working Group of the International Forensic Genetics Society and the Forensic Genetics Committee of the Polish Society of Forensic Medicine and Criminology.

RESUMO

As the number of disability claims increases, so does the demand for forensic disability evaluations. However, an examiner's lack of knowledge and understanding of the nature and nuances of disability evaluations can threaten the validity of these evaluations. Although many threats to validity are outside the control of the examiner, this article identifies eight examiner-related threats to validity in terms of conceptual errors, errors in data collection, and inferential errors. Following this, six suggestions for reducing such threats are presented.

RESUMO

Research and development can be classified into three categories: technology adoption, technology extension, and knowledge and technology creation. In general, technology adoption is embedded in operational forensic science laboratory practice but the latter two categories require partnerships with industry and/or academia both to conduct the research and implement the outcomes. In a 2012 survey, Australian and New Zealand forensic science laboratories identified a number of 'roadblocks' to undertaking research and operationalizing research outcomes. These included insufficient time and funding, a lack of in-house research experience and the absence of a tangible research culture. Allied to this is that, increasingly, forensic science research is conducted in a 'commercial in confidence' environment and the outcomes are not readily or cost-effectively available to be integrated into operational forensic science laboratories. The paper is predominantly reflective of the current situation in Australia and New Zealand.

RESUMO

We are at a critical juncture for the forensic sciences. A number of high-profile reports and a growing body of literature question and critically reflect on core issues pertaining to the methodologies informing forensic science and their effective use within the criminal justice system. We argue for the need for an improved association and outline key areas that require attention from practitioners operating within the fields of both forensic science and law.

RESUMO

The purpose of this article is to introduce the concept of the balanced scorecard into the laboratory management environment. The balanced scorecard is a performance measurement matrix designed to capture financial and non-financial metrics that provide insight into the critical success factors for an organization, effectively aligning organization strategy to key performance objectives. The scorecard helps organizational leaders by providing balance from two perspectives. First, it ensures an appropriate mix of performance metrics from across the organization to achieve operational excellence; thereby the balanced scorecard ensures that no single or limited group of metrics dominates the assessment process, possibly leading to long-term inferior performance. Second, the balanced scorecard helps leaders offset short term performance pressures by giving recognition and weight to long-term laboratory needs that, if not properly addressed, might jeopardize future laboratory performance.

RESUMO

The Association of Chief Police Officers commissioned Skills for Justice to develop a competence assessment framework to support police forces' scientific support units evidence the competence of their staff against nationally agreed standards of competence. This will also help forces on their journey towards ISO 17025 and ISO 17020 accreditation. A six point framework has been developed and published and is now being implemented across many forces.

Assessing informants' credibility is critical to several aspects of the legal process (e.g., when police interrogate suspects or jurors evaluate witnesses). There is a large body of research--from various areas of psychology and allied fields--about how people evaluate each others' credibility. We review the literature on lie detection and interpersonal perception to demonstrate that inferences regarding credibility may be multiply determined. Specifically, characteristics of the informant, of the listener, and of the situation affect people's perceptions of informants' credibility. We conclude with a discussion of research on calibration (i.e., an informant's confidence-accuracy relation) because it offers fruitful avenues for future credibility research in the legal domain.

Daubert v Merrell Dow Pharmaceuticals, Inc should have an extraordinary impact on criminal litigation, because there is rarely a criminal trial that does not rely on some form of expert testimony. In fact, it is almost irrelevant. Despite the frequency of prosecution proffered scientific and expert testimony in criminal cases, Daubert is rarely invoked to challenge it. In civil cases, when expert testimony is challenged in criminal proceedings, the outcome could not be more different. Because most violent crimes are committed by the poor, their court appointed advocates--overworked and under-financed--are not up to the challenge. In the absence of a system of effective representation, Daubert will not improve scientific evidence in criminal cases. The only way to guard against the misapplication of forensic science is to impose controls and reforms long before the cases come to court.
