Amianto, saúde do trabalhador e poder judiciário trabalhista: respostas do Tribunal Regional do Trabalho do Rio de Janeiro às demandas relativas à exposição ocupacional ao asbesto / Asbestos, workers' health and labor judiciary: answers from the Regional Labor Court of Rio de Janeiro occupational exposure to asbestos
O presente estudo analisou as respostas do Poder Judiciário Trabalhista às demandas relativas à exposição ocupacional ao amianto, tendo como pergunta norteadora se haveria decisões que chacelariam o adoecedor processo produtivo do asbesto, ao invés de proteger a saúde daqueles que laboram.
Objetivos:
Analisar as respostas do Tribunal Regional do Trabalho da 1ª Região, que corresponde ao Estado do Rio de Janeiro, em grau recursal, às demandas relativas à exposição ao amianto, no período de 2007 a 2017. Mais especificamente, buscou-se conhecer o perfil das ações sujeitas a recurso e o posicionamento do órgão julgador sobre prescrição e responsabilidade civil, bem como identificar se o Nexo Técnico Epidemiológico teria sido utilizado na elaboração das decisões.
Método:
A metodologia fundou-se em pesquisa exploratória e documental em acórdãos judiciais publicados na página da internet do Tribunal citado.
Resultados:
Constatou-se que a atuação do Judiciário Trabalhista encontra-se, inicialmente, limitada pelos tipos de ação proposta, as quais são, em sua maioria, individuais e com pedidos indenizatórios. Quando instado a se manifestar em tais ações o Tribunal impôs ao trabalhador o ônus da prova da existência da doença e do nexo de causalidade entre a enfermidade e a atividade desenvolvida, bem como da culpa do empregador, não obstante seja de risco a atividade que envolve exposição ao amianto. Nas ações em que os obreiros conseguiram se desincumbir de seus encargos probatórios, o Judiciário deferiu indenizações não módicas, imprimindo caráter pedagógico à reprimenda. O acolhimento da prescrição bienal contado após o término do contrato mostrou-se exceção, ocorrendo em apenas um caso.
Introduction:
The present study analyzed the decisions of the Labor Judiciary to the demandsrelated to occupational exposure to asbestos, taking as a guiding question whether decisions would be made that would not inhibit harmful practices related to the productive process of the abestos, rather than protect the worker´s health.
Objectives:
To analyze the responses of the Regional Labor Court of the 1st Region, which corresponds to the state of Rio de Janeiro, in a recursional degree, to the demands related to exposure to asbestos, in the period from 2007 to2017. More specifically, it was sought to know the profile of the legal actions subject to appealand the position of the judicial body regarding the limitation period and liability, as well as to identify if the Technical Epidemiological Nexus would have been used in the elaboration of the decisions.
Methodology:
The methodology was based on exploratory and documentary research in judicial rulings published on the Court's website.
Results:
It was found that the workof the Labor Judiciary is initially limited by the types of lawsuits proposed, which are, in their majority, individual and with indemnification requests. When asked to manifest itself in such lawsuits, the Court imposed on the worker the burden of proving the existence of the disease and the causal link between the illness and the activity carried out, as well as the employer's fault, notwith standing the activity involving exposure to asbestos be a risky one. In suits inwhich the workers were able to discharge their burden of proof, the Judiciary granted nonmodest damages, giving a pedagogical character to the reprimand. The reception of the bienniallimitation period counted after the end of the contract was an exception, occurring in only one case.
