Os crimes na lei de licitações: principais aspectos legais e jurisprudenciais / The crimes in the law of bids: key legal and jurisprudential aspects

RESUMO

No seguinte estudo buscou-se demonstrar ser o instituto da licitação pública um terreno fértil e corriqueiramente usado para a propagação de atos corruptivos e os reflexos deste quadro na sociedade. Inicialmente buscou-se demonstrar a intima ligação que as licitações possuem com os princípios constitucionais e expor os demais princípios que devem ser observados no certame licitatório. Depois foi abordado o tema da corrupção nas licitações, seu histórico e a situação brasileira quanto à temática. Então, analisaram-se de maneira geral e histórica os crimes previstos na Lei de Licitações, além de expormos os resultados de pesquisa realizada no Tribunal de Justiça do Rio Grande do Sul (TJRS) quanto ao tema de crimes nas licitações. Por fim, foram analisados os dois tipos penais de maior incidência no TJRS de forma mais especifica e aprofundada.

ABSTRACT

In the ensuing study it was sought to demonstrate that the organization of public bidding is a fertile soil and routinely used for the broadcast of corruptive acts and reflections of this framework in society. Initially it was sought to demonstrate the intimate connection bids have with constitutional principles and expose other principles that must be observed in these processes. Afterwards it was approached the issue of corruption in biddings, its history and the Brazilian situation regarding this theme. Then, it was analyzed in a general and historical way the crimes defined in the Public Bidding Law, and it was exposed the research results conducted at the Court of Justice of Rio Grande do Sul (TJRS) on the subject of bidding crime. Lastly, it were analyzed the two higher incidences of criminal types in a more specific and deep arrangement.
