RESUMO
As cooperativas médicas do grupo Unimed são hoje modalidade de grande expressão no mercado de assistência médica suplementar, pois reúnem o maior número de beneficiários e concentram o maior faturamento do setor. À luz de decisão do Superior Tribunal de Justiça (STJ), que reconheceu a responsabilidade solidária em relação a obrigações contratadas por qualquer empresa pertencente ao grupo Unimed, o presente artigo analisa argumentos e repercussões do julgado. O dever de transparência decorre do direito básico do consumidor de receber informações claras e adequadas sobre serviços e produtos comercializados. Já a boa-fé objetiva está ligada à lealdade que as partes devem manter em todas as fases da contratação, em respeito às legítimas expectativas criadas. Conclui-se que o posicionamento do STJ, pela responsabilidade solidária de todas as empresas do grupo Unimed, é um desfecho lógico e necessário...
ABSTRACT
Unimed medical cooperatives a Brazilian private health insurance- are a very expressivegroup in the Brazilian supplementary healthcare market, as they bring together the largestnumber of beneficiaries and present the highest turnover in the sector. In light of the decision of the Brazilian Superior Court of Justice (STJ) recognizing the solidarity liability related to obligations of any company belonging to the group Unimed, this article analyzes arguments and implications of this judgment. The transparency obligation stems from thebasic consumers right to receive clear and adequate information on the marketed servicesand products. As for the good faith, it is linked to the loyalty that the parties must maintain at every stage of the contract, in respect to the expectations created. This article concludesthat the STJs position, related to the responsibility of all companies of the Unimed Group, is a logical and necessary outcome...
