RESUMEN

Autism spectrum disorder (ASD) is a neurodevelopmental condition characterized by marked differences in communication patterns, reciprocal social interactions, and restricted, stereotyped, and repetitive interests and activities. Various behavioral problems in ASD, more so when accompanied by coexisting psychopathology, can sometimes lead to legal problems. In this study, the cases in which an opinion was requested in terms of criminal responsibility with the diagnosis of ASD in the 5-year period between 2018 and 2022 in the expertise department of psychiatric observation, where psychiatric cases were hospitalized and observed in the Council of Forensic Medicine (CFM), which is the official expert institution in Türkiye, were retrospectively evaluated. The mean age of the group whose criminal responsibility was reduced or removed was 22.9 years (±7.52) and the mean IQ score was 76.63 ± 18.94. The most common crime in this group was intentional injury (5/11), and it is noteworthy that the victims of these crimes were usually relatives of people with ASD (5/6). The criminal acts of people with ASD are usually single-movement, spontaneous, unplanned, impulsive acts. In addition, although there is no problem in cognitive perception in people with high functioning ASD (HF-ASD), various forensic situations may arise due to defects in emotional awareness. When we look at the practices of the CFM in Türkiye, it is seen that in cases where the diagnosis of ASD is clear and can be associated with the crime, criminal responsibility is usually completely eliminated. In HF-ASD types, although it is important to be associated with the crime, it is seen that criminal responsibility is generally reduced.

Objective: The principal objective aims to assess a possible relationship between epilepsy and aggressive behavior. Secondarily, we intend to study how epilepsy relates to criminal liability. Methods: A systematic literature review was performed, using the Web of Science,United States National Library of Medicine (PubMed),and Scielo databases. The searches were conducted in May-June 2022 and covered the period from 2000 to 2022. Eligibility criteria consisted on original articles in English and Portuguese that were interested in the association of epilepsy, criminal behavior (with aggression directed to others), criminal liability in adults with epilepsy. Results: The search yielded 921 results, 794 of which in PubMed, 115 in Web of Science, and 12 in Scielo. Articles that failed to meet the inclusion criteria (206) and duplicates (201) were excluded. Conclusion: There were no findings to indicate a significant increase in aggressive behaviors in individuals with epilepsy. However, it was possible to identify a higher prevalence of aggressive acts in males with epilepsy, besides the presence of comorbidities with mental disorders and substance use. In addition, the results suggest that in criminal offenders with epilepsy, the seizures originated in the temporal and frontal cerebral lobes. Further researchis necessary on the relationship between epilepsy, criminality, and criminal liability in order to produce more robust data to support legal proceedings.


Objetivo: O objetivo principal visa avaliar uma possível relação entre epilepsia e comportamento agressivo. Secundariamente, pretendemos estudar a relação entre epilepsia e responsabilidade penal. Método: Foi realizada uma revisão sistematizada da literatura, utilizando as bases de dados Web of Science, United States National Libraryof Medicine (PubMed) e Scielo. As buscas ocorreram no período de maio e junho de 2022, verificando o período de 2000 à 2022. Os critérios de elegibilidade consistiram em artigos originais em inglês e português, com interesse na associação entre epilepsia, comportamento criminoso (com violência direcionada a outros) e responsabilidade penal em adultos com epilepsia. Resultados: Foram encontrados 921 resultados na busca, sendo 794 na base de dados PubMed, 115 na Web of Science, e 12 na Scielo.Aqueles que não preencheram os critérios de inclusão (206) e duplicados (201) foram excluídos. Conclusão: Não houveram achados suficientes que indicassem um aumento significativo de comportamentos agressivos na população epiléptica. Entretanto, em relação a esse aspecto, foi possível estabelecer maior prevalência no sexo masculino, presença de comorbidades com transtornos mentais, além de uso de substâncias. Além disso, os resultados sugerem que, em infratores epilépticos, as crises foram provenientes das regiões temporo-frontais do cérebro. Em suma, é importante que a relação entre comportamento criminoso, epilepsia e imputabilidade penal continue sendo estudada, de modo a trazer dados mais sólidos para embasar procedimentos judiciais.

RESUMEN

The purpose of this work is to consider the problems arising from the improper provision of medical services and bringing to civil and criminal liability for these actions of medical organizations and medical workers. The author investigates the issues of bringing to responsibility for violations related to improper provision of medical care in medical organizations of the healthcare system of the Russian Federation. Russian legislation enshrines the right of a patient to complain about the improper provision of medical services, both when applying to a state medical organization and when receiving medical care in private structures of the healthcare system. The problem of bringing to civil and criminal liability for improper provision of medical care in Russian healthcare has been standing for quite a long time, nevertheless, today it is coming to the fore, despite attempts to improve the legislative regulation of this issue. In conclusion, authors conclude that in order to achieve high-quality medical services, it is necessary not only to comply with the requirements for the contractor, provided by licensing of medical activities and accreditation of medical specialists, but also to establish requirements for the activities of medical workers themselves. Thus, the provision of medical services should be considered improper if they are provided in violation of the requirements imposed on the subject and are provided in an improper way, i.e. in violation of the requirements that must be met by medical workers.

OBJECTIVE: The aim: Based on the specifics of the criminal legislation, which provides liability for collaborative activity, it is necessary to offer an adequate understanding of the limits of the criminal liability of pharmaceutical employees for these criminal offenses, as well as to determine the characteristics of the components of these criminal offenses related to the pharmaceutical activities carried out by pharmaceutical employees. PATIENTS AND METHODS: Materials and methods: The conducted research is based on the analysis of the provisions of the criminal legislation of Ukraine and Georgia. CONCLUSION: Conclusions: The main problems of criminal liability for collaboration activities by pharmaceutical employees are connected to the following: without clari-fication of the aforementioned criminal offenses, it is impossible to specify the limits of criminal liability.

OBJECTIVE: Patients with epilepsy who have been charged with a serious offense may be referred by the courts for forensic psychiatric examination. A detailed psychiatric and neurological examination is often necessary to assist the courts in making the right decision, as exemplified in the current case presentation. METHOD: The forensic case of a 30-year-old Tunisian male with temporal epilepsy who exhibited an inadequate response to the treatment is presented here. The patient attempted to kill his neighbor after a cluster of seizures, showing apparent postictal aggression. An antiepileptic treatment was introduced a few days after the person's detention and was followed by forensic psychiatric examination, but the latter was not done until three months afterwards. RESULTS: On forensic examination, the patient's thought processes were clear with no evidence of a thought disorder or psychosis. Both medical and psychiatric opinions stated that the attempted homicide was due to a postictal psychosis. The patient was transferred to a psychiatric facility for further management and was found not guilty by reason of insanity. CONCLUSION: This case illustrates the difficulties that experts may encounter in establishing criminal liability after aggressive behavior associated with epilepsy. It highlights shortcomings in Tunisian law (and promptness of forensic psychiatric examination) that should be addressed to ensure fairness of the legal process.

Introducción: A pesar de su antigüedad la cuestión de la responsabilidad jurídico-penal del profesional de la salud adquiere cada vez mayor importancia en el orden teórico y práctico, en cuyo escenario se pone de manifiesto una excesiva judicialización de la actividad médica como mecanismo de tutela de los derechos del paciente. Objetivo: Sistematizar las diferentes posturas teóricas que en la actualidad se aprecian en torno a la judicialización de la actividad médica y las causas que la estimulan. Método: Se llevó a cabo un estudio de carácter documental a través de una revisión bibliográfica exhaustiva en buscadores bibliográficos como Scopus, SciELO, Google Académico y PubMed. La indagación de carácter argumentativa y exploratoria se realizó el 16 de marzo de 2023 y de los 30 artículos encontrados que abordaron la problemática de la mala praxis médica, solo 11 fueron elegidos para el estudio según criterios de selección. Desarrollo: Se sistematizaron las posturas teóricas sobre la judicialización de la actividad médica y las causas que la estimulan; además se determina la correcta interpretación de la lex artis como mecanismo de heterointegración normativa del deber de cuidado del ejecutor de actos médicos, en aras de evitar excesos en la aplicación de la ley penal en este ámbito de actuación profesional. Consideraciones finales: Una mayor intervención del Derecho Penal en el ejercicio de la Medicina no es el paradigma político criminal más eficiente en aras de proteger la vida e integridad del paciente frente a hechos de mala praxis médica.


Introduction: Legal and criminal liability of the health professionals, regardless its antiquity, at present has becoming more and more theoretical and practical relevance in which an excessive judicialization of medical activity is revealed as a mechanism for the protection of patient rights. Objective: Systematization of the different theoretical positions that are currently identified around the judicialization process of medical activity and the likely causes that stimulate it. Method: A documentary study was carried out through an exhaustive bibliographic review in bibliographic search engines such as Scopus, SciELO, Google Scholar and PubMed. The argumentative and exploratory research was conducted on March 16, 2023 and of the 30 articles found concerning medical malpractice, only 11 were chosen for the study with strict selection criteria. Development: The theoretical positions on the judicialization of medical activity and the causes that stimulate it were systematized; in addition, the correct interpretation of the lex artis was presented as a mechanism of normative heterointegration of the duty of care by the medical personnel, in order to avoid excesses in the application of the criminal law in this area of professional activity. Final considerations: A much greater intervention of criminal law in the practice of medicine is not the most efficient policy to protect the life and integrity of the patient in the face up to the medical malpractice.


Introdução: Apesar de sua idade, a questão da responsabilidade jurídico-penal do profissional de saúde adquire cada vez maior importância na ordem teórica e prática, cenário em que se revela uma excessiva judicialização da atividade médica como mecanismo de proteção dos direitos. do paciente. Objetivo: Sistematizar as diferentes posições teóricas que se apreciam atualmente em torno da judicialização da atividade médica e as causas que a estimulam. Método: Foi realizado um estudo documental por meio de revisão bibliográfica exaustiva em buscadores bibliográficos como Scopus, SciELO, Google Acadêmico e PubMed. A investigação argumentativa e exploratória foi realizada no dia 16 de março de 2023 e dos 30 artigos encontrados que abordavam o problema da impericía médica, apenas 11 foram escolhidos para o estudo de acordo com os critérios de seleção. Desenvolvimiento: Foram sistematizados os posicionamentos teóricos sobre a judicialização da atividade médica e as causas que a estimulam; Além disso, determina-se a correta interpretação da lex artis como mecanismo de heterointegração normativa do dever de cuidado do executor de atos médicos, a fim de evitar excessos na aplicação do direito penal neste campo de atuação profissional. Considerações finais: Uma maior intervenção do Direito Penal no exercício da Medicina não é o paradigma político criminal mais eficiente a fim de proteger a vida e a integridade do paciente contra atos de imperícia médica.

Introducción: El error está presente en cualquier actividad humana y la práctica de la medicina no es una excepción. Debido al aumento de los conocimientos sobre la salud y las enfermedades, la posibilidad de error, relacionada con la atención de estas últimas, disminuye, pero no se ha eliminado en su totalidad. Objetivo: Exponer las experiencias de los autores acerca del error en la práctica médica. Métodos: Revisión bibliográfica entre los años 2000 y 2020. Se localizaron y consultaron fuentes bibliográficas validadas en: Medline, PubMed y SciELO, a las que se accedió a través de la biblioteca virtual de salud. Se utilizaron para la búsqueda las palabras clave error médico, iatrogenia, responsabilidad penal del médico, método clínico. Se revisaron también tres bibliografías anteriores que se consideraron de utilidad para el artículo y tres capítulos de libros con temas afines, además de las resoluciones del Ministerio de Salud Pública de Cuba que tratan acerca del error médico. Al final se seleccionaron 21 bibliografías en idiomas español e inglés. Conclusiones: Existen grandes posibilidades de errores en el proceso del diagnóstico y tratamiento de los enfermos. El desarrollo de la tecnología y la mejoría en la construcción de guías y protocolos disminuyen las probabilidades de equivocaciones, pero no las eliminan. El perfeccionamiento en la formación de recursos humanos, unido al uso correcto del método clínico es una estrategia eficaz para disminuir los errores en la práctica médica(AU)


(AU)ntroduction: Error is present in any human activity; the medical practice is not an exception. Due to an increase in knowledge about health and diseases, error possibility related to disease management is decreasing, but has not been totally eliminated. Objective: To expose the authors' experiences regarding error in medical practice. Methods: A bibliographic review was carried out, covering the years between 2000 and 2020. Validated bibliographic sources were located and consulted in Medline, PubMed and SciELO, accessed through the Virtual Health Library. The following keywords were used for the search: error médico [medical error], iatrogenia [iatrogenic error], responsabilidad penal del médico [physician criminal liability] and método clínico [clinical method]. Three previous bibliographies considered useful for the article and three book chapters with related topics were also reviewed, in addition to the resolutions of the Ministry of Public Health of Cuba dealing with the topic of medical error. Finally, 21 bibliographies in Spanish and English were selected. Conclusions: There are great possibilities of errors in the process of patient diagnosis and management. The development of technology, as well as the improvement in the construction of guides and protocols, decreases the probabilities of errors, but do not eliminate them. The improvement in the training of human resources, together with the correct use of the clinical method, is an effective strategy to reduce errors in medical practice(AU)

There is a ubiquitous problem with medical errors and the concomitant costs it brings in terms of human suffering and financial loss for patients, families, and caregivers. Professional caregivers, including physicians, nurses, and others who have made clinical errors normally will fall under the risk management and quality improvement policies of the organization at which they are employed and subsequent investigation and response occurs internally. Sometimes further consequences can entail the caregiver being named as a defendant or codefendant in a civil lawsuit, and sometimes the caregiver can have professional licensure restricted or even revoked. More rarely, a caregiver can be prosecuted in a criminal legal action. When criminal prosecution occurred, it was usually for purposeful wrongdoing such as fraud, diversion of drugs, or even the intentional or reckless killing of elderly or other vulnerable people. The recent criminal prosecution of a Tennessee nurse for the reckless series of mistakes that led to the death of a single patient opens new considerations for nurses, physicians, and all caregivers, along with hospitals and healthcare systems that employ and/or work with them. The "dynamic tension" of encouraging all caregivers to own up to mistakes with patients as quickly as possible in healthcare organizations seems to be especially challenged now by the Vaught decision. This was mitigated somewhat by a relatively lenient sentence ordered by the judge in this noteworthy case.

RESUMEN

The COVID-19 (coronavirus disease 2019) pandemic has markedly affected the life of people worldwide. In Poland, one of its consequences consisted in new laws being put into force to regulate the provision of healthcare services. This gave rise to much anxiety and concern within the healthcare community, particularly among the specialists in interventional medicine. Taking into account all signals received by the National Consultant, Voivodeship Consultants, as well as the Association of Polish Surgeons and the Polish Chamber of Physicians and Dentists, the new regulations negatively affect the performance of healthcare professionals, e.g. in the context of diagnostic and therapeutic decision-making or activities potentially beneficial for patients not being undertaken. The authors of the article have analyzed the regulations in force in an attempt to bring their interpretation into line with their substance and their objective, as well as to provide comprehensive answers to questions and concerns as raised by interventional surgeons.

RESUMO O objetivo deste artigo é discutir a ofensa sexual cometida por adolescentes/jovens adultos e as implicações sociais e jurídicas decorrentes. A adolescência é um período em que ocorrem mudanças significativas e a ofensa sexual é uma questão de saúde pública, complexa e multideterminada. Cometer ofensa sexual na faixa etária entre 16-21 anos traz a necessidade de compreensão contextualizada, pois envolve dimensões jurídicas diferenciadas. Trata-se de uma pesquisa documental com os prontuários de cinco adolescentes atendidos em uma instituição de saúde pública. Os dados foram analisados a partir de categorias que conectam as vitimizações a aspectos sociofamiliares e implicações jurídicas. Os resultados apresentaram a polivitimização na história de vida e um ponto limite de virem a lidar com conjunto de regras de criminalização ou de proteção, de enfrentarem contextos jurídicos com legislações diferentes, quando ainda pertencem ao mesmo contexto familiar e à mesma comunidade. A responsabilização não pode ser a única resposta.


ABSTRACT The purpose of this article is to discuss the sexual offense committed by adolescents/young adults and social and legal implications. Adolescence is a period that significant changes occur and sexual offense is a complex and multi-determined public health issue. Committing sexual offense between 16-21 years old brings the need for contextualized understanding because it involves different legal dimensions. This is a documental research with the records of five adolescents treated at a public health institution. The data were analyzed with categories that connect victimization to social and family aspects and legal implications. The results presented polyvictimization in life history and a limiting point of coming to deal with a set of rules of criminalization or protection, of facing legal contexts with different laws, when they still belong to the same family context and the same community. Criminal liability cannot be the only answer.

OBJECTIVE: The aim: This article aims to raise awareness and stimulate serious discussion about the dangers of illegal Internet pharmacies for patient safety and public health, the necessity to improve legal instruments, and unite the efforts of governments, professional organizations, and civil society for combating this activity. PATIENTS AND METHODS: Materials and methods: This study is based on the Medicrime Convention, empirical and analytical data of the WHO, Interpol, Europol, NABF, Directive 2011/62/EU of the European Parliament and of the Council of June 8, 2011, the regulatory acts and juridical practice of Ukraine, experts interview of pharmacy practicians, analysis of websites. Totally 18 laws and papers, 34 court judgments, 50 websites were analyzed, six experts were interviewed. Dialectical, comparative, analytic, synthetic, system analyses and sociological research methods were used. RESULTS: Results: Illegal Internet pharmacies are widespread in Europe, especially during the COVID-19 pandemic. This black market poses a severe threat to patient safety and public health as falsifying, substandard, and smuggled medicines are sold through these channels. Without any exception, all illegal pharmacies sell prescription drugs without any prescriptions. Regulatory and protective legal instruments at the national and international levels are insufficient to counter the Internet trade in medicines. CONCLUSION: Conclusions: The widespread proliferation of illegal Internet pharmacies in Europe requires European states to work together to protect patient safety and public health. A legal mechanism needs to be established to exchange information and combat illegal pharmaceutical activities on the Internet at the international level. At the national level, it is necessary to strengthen control over the wholesale of prescription medications to prevent them from entering the black market.

RESUMEN

The study established that in the Chelyabinsk Oblast remains high percentage of violent deaths because of presence of ethyl alcohol and narcotic substances detected in blood of the perished. The increase of concentration of ethanol in blood of the dead testifies the need for inter-sectorial measures, including toughening of legal responsibility for alcohol and drugs consumption. Actually,there is no regulatory documents of the Russian Federation that fix the issue of both progression of toughening this responsibility depending on concentration of ethyl alcohol in organism of offender and responsibility scale depending on specific drug or other substance.

Recent parliamentary inquiries into end-of-life choices identify the need to provide legal certainty for health practitioners working in end-of-life care. A concern identified is the lack of clarity surrounding the operation, status and application of the doctrine of double effect. This discussion clarifies these concerns. Although the doctrine is judicially recognised in several overseas jurisdictions, in Australia the doctrine of precedent means that it does not form part of the common law. In most jurisdictions, the fault element for murder includes recklessness, and application of the doctrine does not avoid criminal liability being established against orthodox criminal law principles. Although the prosecution of a medical practitioner who incidentally causes death in the proper course of medical treatment is a rare event, it remains a live issue. Legislative protection of medical practitioners, as has occurred in Queensland, South Australia and Western Australia, is the means to achieve the certainty sought.

This paper is entirely devoted to a new legal instrument called the "Good Samaritan Clause". Its legal recognition constitutes the legislator's response to the concerns raised by the medical community, in view of the unique situation in the country, but also in the world, relating to the prevention, counteraction and suppression of COVID-19. The assumption is that this instrument is to constitute a countertype that excludes the criminal unlawfulness of the act, due to the increased risk of mistakes made by the physicians involved in providing health services during the epidemic. The paper focuses primarily on the dogmatic and legal issues, discussing the catalogue of conditions needed for the application of the instrument mentioned in the title, but it also attempts to critically evaluate the introduced solution. The idea itself of introducing a solution affecting the scope of criminal liability of physicians is good, however, it requires legislative clarification as well.

OBJECTIVE: The aim: Establishing the forms of criminal liability in case of death of the patient and the presence of such a condition as the desire of the relatives of the deceased to reconcile with the subject of the criminal offense. PATIENTS AND METHODS: Materials and methods: In the course of the study, 62 court judgements were used. Comparative, systematic, analytic, and empiric research methods have been used in this research. RESULTS: Results: The position of the victims - relatives of the deceased - has a direct influence on the choice of the form of criminal liability. A medical worker who is the subject of a criminal offense may reconcile with the relatives of the deceased patient and enter into a reconciliation agreement. It is the parties of the agreement who consent to the punishment and the possible exemption from it. At the same time, the court cannot exempt a medical worker from criminal liability in case of a patient's death. This thesis is based on the fact that the possibility of such exemption is directly related to the reconciliation with the victims who are patients that were provided with medical service. Besides, death is a consequence that is irreversible. CONCLUSION: Conclusions: The exemption from criminal liability according to the reconciliation of the guilty person with the victim in case of death of a patient is stated to be impossible. At the same time, the possibility of concluding a reconciliation agreement in this case has been established.

OBJECTIVE: The aim: The purpose of this article is to analyze the state policy of several states in creating an effective mechanism in which persons entering into marriage will be able to obtain the necessary information about the state of each other's health and thereby make an informed decision about registering a marriage, protecting the health of each other and future offspring. PATIENTS AND METHODS: Materials and methods: In the course of the study, a comparative analysis of the legal means used by some states in the field of biological protection of marriage was carried out. First of all, a study was carried out of the family legislation of states with different approaches to the system of premarital medical examination of persons entering into marriage. In addition, the scientific works of scientists from different countries were used, the object of study of which was the problems associated with the biological protection of marriage. The work also used the results of surveys that were conducted in some countries and highlighted in published scientific works. CONCLUSION: Conclusions: Health information is essential when deciding whether to marry. Hiding such information can seriously harm the partner's health and children born in such a union. The task of the state is to find a middle ground, in which the balance of interests of the person, whose medical examination revealed health problems (the right to medical secrecy), on the one hand, and the person with whom it is planned to register a marriage (the right to health protection; the right on the voluntariness of marriage).At the same time, the emphasis in state policy on the biological protection of the family should be placed on preventive measures, including non-legal means of information.

The forensic psychiatric expertise of homicide perpetrators is a standard practice in criminal justice matters. Its validity relies heavily on the knowledge, professional experience and methodology of forensic psychiatrist experts. In the present interview, Daniel Zagury, an important figure of forensic psychiatric expertise in France, shares his clinical practice. In addition, he describes his experience with homicide perpetrators, particularly with serial killers and Islamic terrorist attackers on French soil. Finally, he addresses the recurring and crucial controversy of criminal responsibility, or the lack of it, in perpetrators.

RESUMEN

The article investigates the legal regime of restrictive measures introduced in Russia due to the COVID-19 pandemic and provides statistical data on the spread of the infection. It describes special administrative violations and criminal offences first introduced during the pandemic: violation of therapeutic and epidemiological rules, dissemination of false information, and failure to follow the procedures introduced during the high-alert regime. Judicial and investigative practice is analysed. The most frequent violations of the legislation establishing requirements and restrictions to organisations and individuals during the spread of the new coronavirus infection are identified and issues of classification and differentiation of administrative and criminal liability for violation of sanitary and epidemiological rules and dissemination of false information about COVID-19 are addressed. Judgments by the Russian Supreme Court ensuring a uniform approach to court cases in all Russian regions are analysed.
