RESUMEN
El internamiento de un enfermo mental en un centro psiquiátrico es un tema complejo por los problemas materiales que genera su tramitación en la práctica diaria, sobre todo en lo que se refiere al transporte y la coordinación con las fuerzas y cuerpos de seguridad del Estado. Se ha realizado una revisión sobre el tema y se abordan, en el marco de la legislación vigente, los aspectos medicolegales de mayor interés que se le plantean al profesional sanitario en el ejercicio de la medicina.Sobre la base de la actual legislación y teniendo en cuenta el consentimiento del paciente, se consideran 2 tipos de internamientos psiquiátricos: a) voluntarios o consentidos, y b) involuntarios, no consentidos o compulsivos. La Ley 1/2000 de Enjuiciamiento Civil, en su art. 763, contempla las garantías legales de los internamientos involuntarios(AU)
Compulsory hospitalization of mentally ill patients in a psychiatric center is a controversial issue due to the problems affecting their management, mainly coordination between health services and the police forces. This subject has been reviewed with major focus on Spanish Law, and also the medicolegal aspects the health professionals have to cope with.We can distinguish two types of psychiatric admissions considering the consent of the patient: a) voluntary or b) compulsory hospitalization.
