Digital medication and patients' right of autonomy in Spain.

The progress the Internet has experienced in recent years has brought about huge changes and social transformation in all aspects of our lives. One such aspect greatly impacted has been our health, where we can talk about the existence of an 'Internet of Medical Things'. Amid this digital drift, we have seen the development of pharmaceutical drugs that provide information to patients and their attending healthcare teams concerning medication, doses ingested, and time of ingestion. These are digital pills or digital medication. In this context, the purpose of my paper is to analyze the ethical and legal impact of digital medication, further analyzing the implications concerning the right of service users to make decisions over their own health in Spain.

El devenir de los tiempos ha favorecido el desarrollo de tecnologías aplicadas a dispositivos, materiales, procedimientos médicos y modalidades terapéuticas desarrolladas, en algunos casos, mediante la convergencia de materiales vivos e inertes, dando lugar al descubrimiento de nuevos tratamientos médicos beneficiosos para la salud y la mejora de la calidad de vida de nuestra especie. En base a estos presupuestos metodológicos el objeto de este trabajo ha consistido en analizar cuáles son los avances más notorios que se han producido en este campo durante los últimos años y cuales es el mapa jurídico de los sistemas de Nanomedicina en un país como España inmerso, actualmente, en una desoladora época de crisis gestionada por las instancias públicas en base a recortes en el ámbito de la salud pública

The evolution has favored the development of technologies applied to devices, materials, medical procedures and therapeutic modalities developed, in some cases, by the convergence of living and inert materials, leading to the discovery of new medical treatments beneficial to health and the improvement of the quality of life of our species. Based on these methodological assumptions the objective of this work has been to analyze which are the most notorious advances that have occurred in this field during the last years and what is the legal map of the systems of Nanomedicine in a country like immersed Spain, Currently, in a bleak era of crisis managed by public bodies based on cuts in the field of public health

La irrupción de la Nanotecnología en el ámbito de la Medicina ha dado lugar al nacimiento de una nueva disciplina científica, la Nanomedicina, que incluye un amplio abanico de tecnologías aplicadas a dispositivos, materiales, procedimientos médicos y modalidades terapéuticas que están siendo desarrollados, en algunos casos, mediante la convergencia de materiales vivos e inertes. Los avances que se están produciendo en este campo científico constituyen el preludio de una nueva era en el ámbito sanitario marcada por el uso de nanotecnologías cuyo desarrollo va a proporcionar, a corto o a medio plazo, beneficios sustanciales para el bienestar general y para la salud de las personas que padecen enfermedades graves e incurables mediante otros tratamientos médicos más tradicionales. Sobre la base de estas premisas, el objeto del presente trabajo ha consistido en delimitar los paradigmas éticos-jurídicos que deberían de presidir los avances y las expectativas generadas por las aplicaciones sanitarias de la Nanotecnología (AU)

Nanomedicine includes a wide range of technologies applied to devices, materials, medical procedures and treatment modalities are being developed, in some cases, through the convergence of living and nonliving materials. The developments in this scientific field are the prelude of a new era in health where Nanotechnology will provide, in a short period of time, substantial benefits for the general welfare and health of people with serious and incurable diseases using other more traditional medical treatments. This is, in brief, the object of this research that has been focused in the study of the ethical-legal paradigms that should inform the developments and expectations generated by medical applications of Nanotechnology (AU)
