RESUMO

Epigenetics invites, by its specific characteristics, to reflect on a variety of questions relating to public policies in a logic of “sustainable health” but also of “lasting respect” for fundamental rights. Thus, preserving a sustainable environment means placing the prospect of a longer human life in a logic of better quality of life, of “sustainable health”, but it is also a matter of public policy. And, if the public policies also have a direct impact on fundamental freedoms, other factors also play a decisive role in this regard, accentuating the specificity of genetic data.

RESUMO

When bioethics, by its multidisciplinary and pluralist nature, calls on many constitutive sources, moral and religious thought as philosophy find all the more their place that bioethics is a culture of discussion to make, if not emerge, less to reconstruct or adapt to their time, values whose history is linked to that of religions and philosophical trends. This brief text has only the interest of synthesizing this contribution in the light of what bioethics is today, a phenomenon in which everyone can find an anchor where, as in the labyrinth of Theseus, he will be able to find his way by following a guideline.

Chapter 3. Human Rights, Gender and Protection of Family and Private LifeThe analysis of the case law gives us the vision of an enlightened reality that is complex and full of nuances. In fact, the European Court of Human Rights has not hesitated to transform in the long term the social, legal and medical vision of transsexualism. However, although the Court remains sensitive to social developments, its approach to the relationship between gender and reproduction remains to a large extent dependent on the margin of appreciation it leaves to States.

RESUMO

Based on the system of liability for defective products as organized by the European Directive of 25 July 1985, responsibility for blood products does not therefore constitute a genuine specific regime. However, European law leaves States a margin of discretion in the implementation of the Directive with regard to health products. This is the case in particular with the exemption for development risk.

RESUMO

The analysis of the complexity and interactivity in the production of social norms between science and technology, on the one hand, and between law and ethics, on the other hand, must be our first concern because without a lucid and in deep assessment of the fragmented and even opposed realities that make up our world, not only do we lose all forms of collective freedom but above all we favor reductive totalitarianism and warlike confrontation.It is with this in mind that it is necessary to examine whether the revision of the 1974 Recommendation on the Status and Responsibility of the Scientific Researcher is likely to provide relevant elements for responding to these changes.

RESUMO

The precautionary principle finds its origin in international law and in the field of the environment but he quickly invested national law and expanded its scope to health issues, as shown by the health crisis that occurred in France since the 1980s. What is the room left to civil law? The reality of a certain ?dialogue' brings a denial to those who saw the marriage of water and fire. In fact, civil law uses the concept of precaution in consideration of the question of liability because the precaution has become an element of assessment of the conditions of liability and its effects.

RESUMO

How legitimate may be the concern posed by the nanotechnologies for health and environment,this effort for reaching a better knowledge of the biotoxicity of nanomaterials is not enough. As Pr Didier Sicard noted, we believe that the ethical reflection should not be the good conscience that may help science in getting rid of social fears. But the ethical reflection is there also to discuss taboo issues in the perspective of a better societal understanding.
