O campo jurídico na garantia do direito à saúde / The judicial field to guarantee the right to health

RESUMO
Considerando que as decisões judiciais ainda conservam a tradição ritualística do modo de operar do campo do direito centrado em uma visão legalista e positivada, este artigo tem o objetivo de compreender como as decisões do Judiciário afetam o cotidiano de cuidados com a saúde de uma família que vivencia a condição crônica por adrenoleucodistrofia. Utilizou-se referencial metodológico da História de Vida Focal com uso da Entrevista em Profundidade, cujas narrativas compõem o corpus de análise. Aponta-se que a atuação do Judiciário ainda é ritualística, conservadora e fragmentária no atendimento à demanda por necessidades de saúde, gerando reiteradas buscas quando se trata de pessoa que vivencia uma condição crônica de caráter degenerativo que exige cuidado permanente e progressivamente mais intenso, como a criança deste estudo. Assim atuando, o Judiciário reforça o modo também fragmentado das práticas do campo saúde, não consubstanciando o princípio da integralidade. Conclui-se que, se o Judiciário adotasse postura de acolhimento às necessidades ampliadas da pessoa e da família, aliada às normas que estruturam o Sistema Único de Saúde, sua intervenção seria um elemento positivo a contribuir com as políticas públicas de saúde, criando uma sinergia com elas e diminuindo, em grande escala, o movimento de judicialização da saúde.
ABSTRACT
Considering that judicial decisions still maintain the ritualistic tradition of the law field based on a legal and positive approach, this paper aims at understanding the effects caused by Judiciary Power in the daily health care of a family who experiences chronic condition adrenoleukodystrophy. It was used the methodological referential of the History of Focal Life with the utilization of the Depth Interview, whose narratives are part of the analysis. It is noticed that the action of the Judiciary is still ritualistic, conservative and fragmented in answering healthdemands which generates repeated new claims in the case of a person with a degenerative chronic condition that requires permanent and progressively more intense care the situation of the child of this study. Acting in this way, the Judiciary reinforces the fragmented methods of the practices in the health field and does not consolidate the integrality principle. It concludes that, if the Judiciary welcomes the needs of the child and his family, together with the rules that structure the Brazilian National Public Health System, its intervention would be a positive element to the public health policies, interacting with them and reducing, in large scale, the health litigation movement.
