ABSTRACT

Normally, family plays an invaluable role concerning the dependent people care, to the extent that the concept of informal care is part of the common speech among the healthcare professionals. However, the participation of relatives in the health care of those hospitalized is still very low. The objective of this paper was to review the available evidence regarding the advantages of promoting the family participation in the hospitalized patient's healthcare, as well as the recommendations that several scientific societies and professional organizations have made in this sense. It has been also studied what is established in the Spanish current law in relation to the presence of the family during the professional process of healthcare. For this, diverse databases and official health organizations' recommendations about the family and the patient were revised, as well as the national, autonomic and local legislation. The evidence provided shows that the accompaniment of the family and its active participation in the healthcare of the patient is very useful to promote its recovering and well-being durina its hospitalization.

Habitualmente, la familia juega un papel inestimable en el cuidado de las personas dependientes, hasta el punto de que el concepto de cuidador informal forma parte del discurso habitual de los profesionales sanitarios. A pesar de ello, su participación en el cuidado del paciente hospitalizado es aún muy baja. El objetivo de este trabajo ha sido revisar las evidencias disponibles respecto a las ventajas de promover la participación de la familia en el cuidado del paciente hospitalizado, así como a las recomendaciones que en esta materia han realizado distintas sociedades científicas y organizaciones profesionales. También se ha querido estudiar lo establecido en la normativa vigente en España respecto a la presencia de la familia durante el acto profesional de cuidado. Para ello se revisaron distintas bases de datos y recomendaciones de organismos oficiales de la salud sobre la familia y el paciente, así como la legislación estatal, autonómica y local. La evidencia aportada pone de manifiesto que es de gran utilidad para fomentar la mejora y el bienestar del paciente que esté acompañado por su familia durante la hospitalización y que esta participe de manera activa en el cuidado (AU)

ABSTRACT

At present times, numerous complaints claiming defects produced at some point in the process of obtaining informed consent are filed in courts of justice; in these complaints there is an underlying comment element which is the roles that health professionals have in these processes. In obtaining this consent, one can see this more as a means to obtain judicial protection for professional practices rather than this process being a respectful exercise for the dignity and freedom which health service patients have. This article reflects on two basic rights related to informed consent: adequately obtaining this consent and the need to protect those people who lack, either partially or totally, the capacity to make this decision by themselves. Afterwards, the author makes some considerations about the necessity to obtain informed consent for nursing practices and treatment.

Actualmente llegan a los tribunales de justicia numerosas reclamaciones por defectos producidos en algún momento del proceso de obtención del consentimiento informado, donde subyace, como elemento común, la vivencia que tienen los profesionales sanitarios de este proceso. En él se ve más un modo de obtener protección jurídica en la práctica profesional que un ejercicio de respeto a la dignidad y libertad de los usuarios de los servicios sanitarios. En este artículo se reflexiona sobre dos deberes básicos en materia de consentimiento informado: su adecuada obtención y la necesidad de proteger a las personas que carecen total o parcialmente de la capacidad de autodeterminarse, para, posteriormente, realizar algunas consideraciones sobre la necesidad de obtener el consentimiento en el ámbito de los cuidados de Enfermería(AU)
