RESUMO

The present study examines the 'fact based' approach to jury instructions, which embeds legal concepts in a series of logically ordered written factual questions that the jury must answer to reach a verdict. The study utilised a sample of 1007 adults called for jury service in Victoria, Australia. Four instructional types (standard, plain language, checklist, fact based) were compared on paraphrase and application measures across three time points. Results indicated that paraphrase performance was significantly lower for standard instructions compared to all other instructional types at the pre-deliberation stage. Findings around application of law were mixed. At the pre-deliberation stage, participants receiving fact based instructions had significantly higher scores on true/false application questions compared with participants in other conditions, whereas there were no significant differences between conditions for multiple-choice application. However, testing following deliberation revealed that participants in the fact-based condition had significantly higher scores on multiple-choice application items.

Prioritization of marsh-management strategies is a difficult task as it requires a manager to evaluate the relative benefits of each strategy given uncertainty in future sea-level rise and in dynamic marsh response. A modeling framework to evaluate the costs and benefits of management strategies while accounting for both of these uncertainties has been developed. The base data for the tool are high-resolution uncertainty-analysis results from the SLAMM (Sea-Level Affecting Marshes Model) under different adaptive-management strategies. These results are combined with an ecosystem-valuation assessment from stakeholders. The SLAMM results and stakeholder values are linked together using "utility functions" that characterize the relationship between stakeholder values and geometric metrics such as "marsh area," marsh edge," or "marsh width." The expected-value of each site's ecosystem benefits can then be calculated and compared using estimated costs for each strategy. Estimates of optimal marsh-management strategies may then be produced, maximizing the "ecosystem benefits per estimated costs" ratio.

Technological advances have dramatically increased the ability to access, distribute and produce child exploitation material (CEM) online, resulting in increased numbers of individuals being charged with CEM offences. This study examined the demographic, mental health, and offending characteristics of CEM offenders (n = 456) in comparison to child contact sexual offenders (n = 493) and offenders with a history of both CEM and contact offences (dual offenders, n = 256). A robust data linkage methodology was employed to link records from statewide corrections services with policing and mental health records in Victoria, Australia. The results indicated that CEM offenders differed from both contact and dual offenders, and that the groups were primarily differentiated based on two factors: antisocial orientation and sexual deviance. CEM offenders demonstrated high rates of sexual deviance but low rates of antisociality, contact offenders exhibited the opposite pattern, and dual offenders had both high sexual deviance and antisociality. The findings suggest that existing sexual offender assessment and treatment frameworks are unlikely to be suitable for exclusive CEM offenders. The implications for future research are discussed.

Bioaccumulation models quantify the relationship between sediment and water exposure concentrations and resulting tissue levels of chemicals in aquatic organisms and represent a key link in the suite of tools used to support decision making at contaminated sediment sites. Predicted concentrations in the aquatic food web provide exposure estimates for human health and ecological risk assessments, which, in turn, provide risk-based frameworks for evaluating potential remedial activities and other management alternatives based on the fish consumption pathway. Despite the widespread use of bioaccumulation models to support remedial decision making, concerns remain about the predictive power of these models. A review of the available literature finds the increased mathematical complexity of typical bioaccumulation model applications is not matched by the deterministic exposure concentrations used to drive the models. We tested a spatially explicit exposure model (FishRand) at 2 nominally contaminated sites and compared results to estimates of bioaccumulation based on conventional, nonspatial techniques, and monitoring data. Differences in predicted fish tissue concentrations across applications were evident, although these demonstration sites were only mildly contaminated and would not warrant management actions on the basis of fish consumption. Nonetheless, predicted tissue concentrations based on the spatially explicit exposure characterization consistently outperformed conventional, nonspatial techniques across a variety of model performance metrics. These results demonstrate the improved predictive power as well as greater flexibility in evaluating the impacts of food web exposure and fish foraging behavior in a heterogeneous exposure environment. RESUMO

This article reviews the current literature pertaining to those who engage in child pornography offending. The basic characteristics of online child pornography offenders (CPOs) and related typologies are briefly presented prior to reviewing the comparative literature pertaining to CPOs and child contact sexual offenders. In general, CPOs have been found to be relatively high functioning and generally pro-social individuals with less extensive and diverse offending histories than contact offenders. CPOs also display high levels of sexual pre-occupation, deviant sexual interests, and deficits in interpersonal and affective domains that surpass those of contact offenders. Although further research is required to replicate and clarify preliminary findings, the available evidence indicates that existing sexual offender risk assessment tools and treatment programs are not suitable for use with CPOs, and thus require revision and empirical evaluation prior to widespread use among this population. The article concludes with implications for clinical practice and directions for future research.

OBJECTIVES: To evaluate and summarise the utility and impact of information communication technology (ICT) in enhancing student performance and the learning environment in pre-registration nursing. DESIGN: A systematic review of empirical research across a range of themes in ICT health-related education. DATA SOURCES: Science Direct, Cinahl, AMED, MEDLINE, PubMed, ASSIA, OVID and OVID SP (2008-2014). Further date parameters were imposed by theme. REVIEW METHODS: Evidence was reviewed by narrative synthesis, adopting Caldwell's appraisal framework and CASP for qualitative methods. Selection and inclusion was grounded in the PICOS structure, with language requirements (English), and further parameters were guided by theme appropriateness. RESULTS: Fifty studies were selected for review across six domains: reusable learning objects, media, audience response systems, e-portfolios, computer-based assessment and faculty adoption of e-learning. Educational ICT was found to be non-inferior to traditional teaching, while offering benefits to teaching and learning efficiency. Where support is in place, ICT improves the learning environment for staff and students, but human and environmental barriers need to be addressed. CONCLUSION: This review illuminates more advantages for ICT in nurse training than previously. The key advantage of flexibility is supported, though with little evidence for effect on depth of learning.

Threshold concentrations for biological impairment by nutrients are difficult to quantify in lotic systems, yet States and Tribes in the United States are charged with developing water quality criteria to protect these ecosystems from excessive enrichment. The analysis described in this article explores the use of the ecosystem model AQUATOX to investigate impairment thresholds keyed to biological indexes that can be simulated. The indexes selected for this exercise include percentage cyanobacterial biomass of sestonic algae, and benthic chlorophyll a. The calibrated model was used to analyze responses of these indexes to concurrent reductions in phosphorus, nitrogen, and suspended sediment in an enriched upper Midwestern river. Results suggest that the indexes would respond strongly to changes in phosphorus and suspended sediment, and less strongly to changes in nitrogen concentration. Using simulated concurrent reductions in all three water quality constituents, a total phosphorus concentration of 0.1 mg/l was identified as a threshold concentration, and therefore a hypothetical water quality criterion, for prevention of both excessive periphyton growth and sestonic cyanobacterial blooms. This kind of analysis is suggested as a way to evaluate multiple contrasting impacts of hypothetical nutrient and sediment reductions and to define nutrient criteria or target concentrations that balance multiple management objectives concurrently.
